1 EXTRACT OF MINUTES OF MEETING <br />2 OF THE <br />3 CITY COUNCIL OF THE CITY OF ROSEVILLE <br />4 * * * * * * * * * * * * * * * * * <br />5 Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of <br />th <br />6 Roseville, County of Ramsey, Minnesota was duly held on the 20day of May, 2024, at 6:00 p.m. <br />7 The following members were present: ; and the following were absent: . <br />8 Councilmemberintroduced the following resolution and moved its adoption: <br />9 RESOLUTION No. <br />10 RESOLUTION VACATING A UTILITY EASEMENT THAT WAS RESERVED BY THE <br />11 CITY IN A PREVIOUS VACATION OF A PORTION OF CARISLE AVENUE LYING <br />12 NORTH OF THE PROPERTIES LOCATED AT 615, 577, AND 571 ROSELAWN <br />13 AVENUE WEST AND A PORTION OF KENT STREET LYING EAST OF 571 <br />14 ROSELAWN AVENUE WEST <br />15 WHEREAS, on November 27, 2023, the City of Roseville vacated a portion of Carlisle Avenue <br />16 that lied north of the properties located at 615, 577, and 571 Roselawn Avenue West and Kent <br />17 Street that lies east of the property located at 571 Roselawn Avenue West by adopting Resolution <br />18 No. 12034; and <br />19 WHEREAS, said vacation reserved an easement for utility purposes within the vacated rights-of- <br />20 way (the “Reserved Utility Easement”); and <br />21 WHEREAS, on April 15, 2024, the City received a petition for vacation of the Reserved Utility <br />22 Easement that was signed by a majority of the abutting property owners; and <br />23 WHEREAS, the City Council pursuant to Minnesota Statutes § 412.851 desires to consider the <br />24 vacation of the Reserved Utility Easement; and <br />25 WHEREAS, the Reserved Utility Easement is legally described on the attached Exhibit Aand as <br />26 shown on the attached Exhibit B; and <br />27 WHEREAS, the City Clerk published, posted, and mailed notice of a public hearing as required <br />th <br />28 by law, and a public hearing was held on the proposed vacation on the 9 day of May, 2024; and <br />29 WHEREAS, there are no utilities in the Reserved Utility Easement and no utilities are planned to <br />30 be constructed by the City within the Reserved Utility Easement; and <br />31 WHEREAS, the City Council in its discretion has determined that the vacation of the Reserved <br />32 Utility Easement will benefit the public interest because the Reserved Utility Easement is not <br />33 needed for current or future utility purposes. <br />RS160\\1\\951840.v1 <br />Qbhf!33!pg!257 <br /> <br />
