<br />REQUEST FOR COUNCIL ACTION <br />Date: 4/22/2024 <br />Item No.: 10.c. <br />Department Approval City Manager Approval <br /> <br /> <br />Item Description: Adopt an Ordinance transferring the procedures for preparation, <br />adoption, and amendment of the Comprehensive Plan from Title 2, <br />Chapter 202 to Title 10, Chapter 1024 and approving an ordinance <br />summary publication <br />1 <br />2 Background <br />3 During the first quarter of 2024, the Council reviewed and updated the Advisory <br />4 Commission chapters of Title 2 of the City Code. Part of this work included Council <br />5 direction to relocate the comprehensive planning sections from Title 2, Chapter 202 to Title <br />6 10, Chapter 1024. As a component of this relocation, Title 10 is also proposed to be <br />7 renamed from "Zoning" to "Zoning and Land Use". No language amendments to these <br />8 comprehensive planning sections are proposed. <br />9 <br />10 The City Attorney has drafted the Ordinance (Attachment 1) to reflect the relocation of <br />11 these sections, including allowance for a summary publication (Attachment 2). <br />12 <br />13 Amendments to Title 10, the Zoning Code, require review and a public hearing before the <br />14 Planning Commission. The public hearing was held on April 3, 2024. No people from the <br />15 public provided testimony (Attachment 3). The Planning Commission voted unanimously to <br />16 recommend approval of the ordinance. No discussion took place other than <br />17 acknowledgment that the language relocation to Title 10 seemed appropriate. <br />18 <br />19 As a reminder, allowance for a summary publication requires a 4/5th vote of the City <br />20 Council. <br />21 <br />22 Policy Objectives <br />23 The objective of Title 10 of the City Code (the Zoning Code) is to govern the use of all land <br />24 and structures in the city. <br />25 <br />26 Racial Equity Impact Summary <br />27 There are no racial equity impacts related to this request. <br />28 <br />29 Budget Implications <br />30 Allowing for publication of a summary in lieu of the entire ordinance will save publishing <br />31 costs. <br />32 <br />33 Staff Recommendations <br />Page 1 of 2 <br />Qbhf!2:4!pg!33: <br /> <br />
