ROSEDALECENTER <br />ELEVATED LAW ENFORCEMENT PRESENCE AGREEMENT <br />This Agreement (“Agreement”) is made by and between the City of Roseville, a municipal <br />corporation (“City”), and Universal Protection Service, LLC dba Allied Universal Security <br />Services (collectively, the “Parties”) as of the effective date below. <br />Recitals <br />WHEREAS, Rosedale owns and operates a regional shopping mall open to the public located <br />within the jurisdiction the City, located at 1595 Highway 36, Roseville, Minnesota 55113 (“Mall <br />Premises”); and <br />WHEREAS, the City is authorized to provide law enforcement services throughout its jurisdiction; <br />and <br />WHEREAS, Malls across the nation have experienced significant and increasing criminal activity <br />on its Mall Premises in recent years, including both property crimes and crimes against persons; <br />and <br />WHEREAS, such criminal activity at Rosedale is of such a concentrated nature so as to detract <br />from the City’s ability to provide satisfactory law enforcement services in other parts of its <br />jurisdiction; and <br />WHEREAS, Rosedale seeks elevated law enforcementpresence at its Mall Premises to provide <br />additional protection for persons and property on its Mall Premises; and <br />WHEREAS, Rosedale wishes to contract with the City to provide dedicated law enforcement <br />presence to assist in providing safety, security, and order at its Mall Premisein a manner that <br />exceeds normal law enforcement presence; and <br />WHEREAS, the City is willing provide such services; and <br />WHEREAS, the Services provided by the City will be in addition to Security Services provided <br />by Universal Protection Service, LLC d/b/a Allied Universal Security Services (“Allied”). <br />NOW, THEREFORE, in consideration of the promises and covenants hereinafter contained, and <br />intending to be legally bound thereby, the City and Rosedale agree as follows: <br />1.Elevated Law Enforcement Presence. The City agrees to provide elevated law <br />enforcement presence at the Mall Premises as follows: <br />A.On-Site Police Officers. The City will providetwo (2) on-duty licensed policeofficers <br />from its Police Department to be stationed at the Mall Premises (the “Assigned <br />Officers”) during certain designatedhours of operation of the Mall Premises for a <br />minimum of 24 hours per week each, fifty-two (52) weeks per year.
