REQUEST FOR COUNCIL ACTION
Date: 5/6/2024
Item No.: 7.a.
Department Approval City Manager Approval

Item Description: Hold a Public Hearing to consider Certifying Unpaid Utility Charges to the
Property Tax Roll
1
2 Background
3 As authorized by City Code, Sections 506, 801,802, and 906, the City annually certifies to the County
4 Auditor any unpaid false alarms, water, sewer, and other charges that are in excess of 90 days past due,
5 for collection on the following year's property taxes. Affected property owners are provided a hearing to
6 dispute any charges against their property.
7
8 Beginning in 2010, the City Council began approving certifications for delinquent utilities on a quarterly
9 basis. This ensures that any unpaid utilities are brought to the attention of new property owners in a
10 more timely fashion. It will also allow the City to record a lien against the property in the event that a
11 property goes into foreclosure and/or is being prepared for sale for other reasons.
12
13 Attached is the current list of delinquent charges. Payments (along with accrued interest) received in the
14 Finance Office prior to April 24, 2024 were accepted and will not be levied on the 2025 property taxes.
15
16 Policy Objectives
17 Certifying delinquent charges are required under City Code.
18
19 Racial Equity Impact Summary
20 There is no anticipated racial equity impact.
21
22 Budget Implications
23 Not Applicable
24
25 Staff Recommendations
26 Staff recommends approval of the attached resolution levying unpaid utility and other charges for
27 collection on the property taxes.
28
29 Requested Council Action
30 Motion adopting the resolution approving the certification of unpaid utility and other charges to the
31 County Auditor for collection on the property taxes.
32
33
Karla Rangitsch, Utility Billing Clerk
Prepared by:
1.
