Attachment 5 <br />since many of the homes to the west along Grandview Avenue were built on parcels of the <br />same width. <br />3. An unusual hardship on the land exists. With a density of about one dwelling per acre, the <br />existing parcel is slightly below the minimum density of 1.5 dwellings per acre and far <br />below the average density of 4.75 dwellings per acre promoted by the Comprehensive Plan <br />in areas guided for low density residential development like the subject site. Of course, the <br />guidance of the Comprehensive Plan does not obligate the property owner to subdivide the <br />existing parcel but, despite the large area of the subject site, there is a tension between the <br />minimum width requirement of the zoning code and the greater density promoted by the <br />Comprehensive Plan. This tension between the advocacy of the Comprehensive Plan and <br />the constraint of the standard zoning provisions constitutes an unusual hardship, which the <br />subdivision variance process is intended to relieve. <br />4. The variance, if granted, will not alter the essential character of the locality. If the <br />requested subdivision variance is approved, the approval will not alter the essential <br />character of the locality because, as noted previously, this area is characterized by 80-foot <br />wide lots like the proposed Lot 1 and Lot 2. <br />NOW THEREFORE, BE IT RESOLVED, by the City Council of the City of Roseville, Minnesota, <br />hereby approves the requested subdivision variance and the proposed Joevia Place preliminary <br />plat, based on the public record and City Council deliberation, with the following conditions: <br />1. Pursuant to the memo from Public Works staff in Attachment 4 of RCA reviewed with this <br />application, the applicant shall: <br />a. Dedicate easements ad indicated in the preliminary plat; and <br />b. Provide an Operations and Maintenance Plan, and record an Operations and <br />Maintenance Agreement in favor of the City, pertaining to the maintenance of the <br />private storm water management BMPs <br />2. In accordance with the recommendation of the Parks and Recreation Commission, the <br />applicant shall dedicate cash in lieu of park land in the amount of $8,500 prior to filing the <br />plat at Ramsey County <br />The motion for the adoption of the foregoing resolution was duly seconded by member and <br />upon a vote being taken thereon, the following voted in favor thereof: ; and the following <br />voted against the same: . <br />WHEREUPON, said resolution was declared duly passed and adopted. <br />RS160\\1\\899047.v2 <br />Qbhf!33!pg!357 <br /> <br />
