Department Approval City Manager Approval Item Description: Schedule a Public Hearing for July 8, 2024 to consider the Massage Therapy Establishment Renewal Application for Winway YH LLC, located at 696 County Road B, and to extend the current license until a final decision is made 1 2 Background 3 Chapter 309, Section 309.04 of the City Code allows the City Council to deny a license for violations of 4 the City Code. In recent months, staff has determined that there are various violations of the City's 5 Building and Fire Codes at Winway YH LLC located at 696 County Road B and violations of Chapter 309 6(Massage Therapy) of the City's Business Licensing Code. Information about the violations will be 7 presented at the Public Hearing on July 8 for the City Council to consider when deciding if a massage 8 therapist establishment license should be renewed for Winway YH LLC for 2024-25. It should be noted 9 that the building and fire code issues are being worked on and may be resolved by July 8. However, the 10 violations of the business license requirements will still need to be addressed on July 8. 11 12 The renewal application and fees have previously been submitted. The current license will expire on 13 June 30, 2024. In order to provide proper notice to Winway YH LLC, staff is requesting the council 14 extend this license until a final decision is made by the City Council. 15 16 Once the hearing date is set, the City will send out a letter to Winway to notify them of the hearing on 17 July 8 and offering them an opportunity to contest the facts before a neutral hearing officer. If they agree 18 with the factual allegations (or fail to request a hearing within 10 days), then the renewal consideration 19 will be held on July 8.
