1 EXTRACT OF MINUTES OF MEETING <br />2 OF THE <br />3 CITY COUNCIL OF THE CITY OF ROSEVILLE <br />4 * * * * * * * * * * * * * * * * * <br />5 Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of <br />th <br />6 Roseville, County of Ramsey, Minnesota was duly held on the 17 day of June, 2024, at <br />7 6:00 p.m. <br />8 The following members were present: , , , , and Mayor . <br />9 and the following were absent: . <br />10 Member introduced the following resolution and moved its adoption: <br />11 RESOLUTION No. <br />12 RESOLUTION OF DECISION OF THE BOARD OF ADJUSTMENTS AND APPEALS <br />13 CONCERNING THE APPEAL BY ERIC CARRARA OF 257 SOUTH MCCARRONS <br />14 BOULEVARD TO REVOCATION OF A FENCE PERMIT <br />15 AND ORDER TO REMOVE A FENCE <br />16 <br />17 WHEREAS, on November 8, 2023, Property owner, Eric Carrara, made application for a <br />18 fence permit to construct a six-foot privacy fence at 257 South McCarrons Boulevard (the <br />19 “Property”); and <br />20 WHEREAS, the permit application included a site plan that did not identify the location <br />21 of property lines or right-of-way lines; and <br />22 WHEREAS, had the site plan identified the location of property lines and right-of-way <br />23 lines, it would have shown that the fence was to be constructed in City right-of-way; and <br />24 WHEREAS, in order to construct in the right-of-way, the Roseville City Code Section <br />25 707.08 requires a permit to obstruct the right-of-way, and the City also requires an encroachment <br />26 agreement between the applicant and the City; and <br />27 WHEREAS, the applicant did not obtain a right-of-way permit and the applicant did not <br />28 enter into an encroachment agreement with the City; and <br />29 WHEREAS, the site plan depicted a front-yard fence which the application stated was to <br />30 “replace existing city fence with a 6ft standard privacy fence”; and <br />31 WHEREAS, in accordance with Zoning Code Section 1011.08 fences in front yards may <br />32 not exceed four feet in height; and <br />33 WHEREAS, the applicant did not obtain a variance in order to build a front-yard fence <br />34 taller than four feet; and <br />35 WHEREAS, on March 12, 2024, City staff approved the permit application; and <br />RS160\\1\\954359.v4 <br />Qbhf!59!pg!331 <br /> <br />
