The Roseville <br />City Council imposed the presumptive penalty (on-sale establishment) for the secondliquor compliance failure/violation <br />specific to the sale of an alcoholic beverage to a person under the age of 21 years. The presumptive penalty for the second <br />violation is a $2000 fine and a five-day suspension of all liquor sales. <br />Consistent with Minnesota law as set forth in Minnesota Statute 340A.415, no fine will be imposed until the license or <br />permit holder has been given an opportunity for a hearing under Minnesota Statute 14.69 of the Administrative Procedure <br />Act. <br />You are hereby notified you have the opportunity to request a hearing on the proposed penalty by providing the City, <br />through the City Manager, a written notice requesting a hearing within ten days of the deliveryof this notice of the City <br />Council’s proposed action. If you request a hearing, the $2000.00 fine and 5-day liquor license suspension will not take <br />effect until after the hearing has been held. <br />If you do not request a hearing by providing written notice to the City by 12:00 p.m. on Thursday, May 23, 2024 the <br />proposed action of the City Council shall be deemed final and the fine and liquor license suspension shall be imposed. If <br />you do request a hearing, an independent hearing officer will be selected by the City Council to conduct a hearing in <br />accordance with the provisions of the Administrative Procedures Act cited above. <br />If you do not request a hearing by the above listed date,yourliquor license will be suspended onMay 24, 25, 26, 27, and <br />th <br />28, 2024. You may resume sales on Wednesday, May 29. The liquor license suspension is for liquor only. You are allowed <br />to stay open for the sale of food. <br />Finally please be advised if another alcohol violation should occur, further penalties will be invoked.
