Regular City Council Meeting <br /> Monday,June 17, 2024 <br /> Page 8 <br /> Councilmember Strahan understood through multiple comments from the public <br /> that people were frustrated with the view and she wanted to make sure if there was <br /> a right or things in a neighborhood that cannot be changed. <br /> Ms. Tierney indicated she was not aware of any rights of the public regarding <br /> views. <br /> Councilmember Etten wondered if staff could speak to the timing of the vacation <br /> process and how that affects the resolution before the City Council. <br /> Mr. Freihammer explained the draft resolution of denail was modified from what <br /> was originally in the packet to require removal of the fence by July 15th instead of <br /> July 8th. Depending on the action the Council would take at the July 8th meeting, <br /> July 15th still could be held as a date or it could be modified. <br /> Mayor Roe indicated if the Council does grant the appeal from the applicant,he did <br /> not know if there needed to be findings of fact. <br /> Ms. Tierney reviewed the protocol for granting the appeal, including a requirement <br /> for findings, which should be articulated as part of the action and memorialized in <br /> a subsequent resolution approved by the Council. <br /> Groff moved, Etten seconded, Adoption of Resolution No. 12076 entitled, <br /> "Resolution of Decision of the Board of Adjustments and Appeals Concerning the <br /> Appeal by Eric Carrara of 257 South McCarrons Boulevard to Revocation of a <br /> Fence Permit and Order to Remove a Fence." <br /> Council Discussion <br /> Councilmember Groff stated he appreciated all of the comments by the public as <br /> well as the information from Mr. Carrera and his attorney. He indicated it is <br /> obvious that the permit application was not complete and should not have been <br /> granted. But, he did think there was enough information missing from the permit <br /> application and he was going on the City Attorney's advice that this is an option <br /> the City has. <br /> Councilmember Etten asked if the Council was amenable to adding the second <br /> piece to the motion indicating: "The fence East of the driveway is located on other <br /> parties'property". <br /> Mayor Roe wondered if that sentence could be added to item 5 of the denial <br /> resolution. <br /> Ms. Tierney offered a revision "...and is on property not owned by the applicant". <br />
