<br />ATTACHMENT 1 <br />1 City of Roseville <br />2 ORDINANCE NO. ________ <br />3 <br />4 AN INTERIM ORDINANCE AUTHORIZING A STUDY AND IMPOSING <br />5 A MORATORIUM ON THE OPERATION OF CANNABIS BUSINESSES <br />6 WITHIN THE CITY OF ROSEVILLE <br />7 <br />8 THE CITY OF ROSEVILLE ORDAINS: <br />9 <br />10 Section 1. Legislative Findings and Authority. <br />11 <br />12(A)The Minnesota Legislature enacted, and the Governor signed, 2023 Minnesota <br />13 Session Laws, Chapter 63 – H.F. No. 100 (the “Act”), which is <br />14 comprehensive legislation relating to cannabis including, but not limited to, <br />15 the establishment of the Office of Cannabis Management (“OCM”), legalizing <br />16 and limiting the possession and use of cannabis and certain hemp products by <br />17 adults, providing for the licensing, inspection, and regulation of cannabis and <br />18 hemp businesses, taxing the sale of cannabis flower, cannabis products, and <br />19 certain hemp products, establishing grant and loan programs, amending <br />20 criminal penalties, and providing for expungement of certain convictions. <br />21 <br />22(B)The Act provides local units of government certain authority related to <br />23 Cannabis Businesses, including the authority to (i) require local registration of <br />24 certain Cannabis Businesses operating retail establishments, (ii) adopt <br />25 reasonable restrictions on the time, place, and manner of the operation of <br />26 Cannabis Businesses, provided that such restrictions do not prohibit the <br />27 establishment or operation of a Cannabis Business, (iii) limit the number of <br />28 certain Cannabis Businesses based on the population of the community, and <br />29(iv) prohibit the operation of a Cannabis Business within 1,000 feet of a <br />30 school, or 500 feet of a day care, residential treatment facility, or an attraction <br />31 within a public park that is regularly used by minors, including a playground <br />32 or athletic field. <br />33 <br />34(C)The Act requires the OCM, which was established effective July 1, 2023, to <br />35 work with local governments to develop model ordinances for reasonable <br />36 restrictions on the time, place, and manner of the operation of Cannabis <br />37 Businesses. The Act also requires the OCM to establish additional rules and <br />38 regulations relating to the operation of Cannabis Businesses. It is anticipated <br />39 that the city of Roseville (the “City”) will benefit from reviewing and <br />40 analyzing the OCM’s model ordinances, rules, and regulations before making <br />41 any decisions related to the regulation of Cannabis Businesses in the City. <br />42 <br />43(D)The Act (Minnesota Statutes, section 342.13(e)) expressly allows a local unit <br />44 of government that is conducting studies or has authorized a study to be <br />45 conducted or has held or scheduled a hearing for the purpose of considering <br />46 adoption or amendment of reasonable restrictions on the time, place and <br />RS160\\1\\957617.v4 <br />Qbhf!6!pg!88 <br /> <br />
