<br />ATTACHMENT 1 <br />92(J)On July 8, 2024, after providing at least 10 days published notice, the City <br />93 Council held a public hearing regarding the consideration and adoption of an <br />94 interim ordinance prohibiting the operation of a Cannabis Businesses within <br />95 the City until January 1, 2025. <br />96 <br />97 Section 2. Definitions. For purposes of this Ordinance, the following terms shall have the <br />98 meaning given them in this section. <br />99 <br />100 (A)“Act” means 2023 Minnesota Session Laws, Chapter 63 (H.F. No. 100). <br />101 <br />102 (B)“Cannabis Business” has the meaning given the term in Minnesota Statutes, <br />103 section 342.01, subdivision 14; and also includes any business that applies for <br />104 or has received a license preapproval as described in 2024 Minn. Laws Art. 2, <br />105 Sec. 148; and also includes any business authorized for early cultivation as <br />106 described in 2024 Minn. Laws Art. 2, Sec. 151. <br />107 <br />108 (C)“City” means the city of Roseville, a Minnesota municipal corporation. <br />109 <br />110 (D)“OCM” means the Office of Cannabis Management, established as set forth in <br />111 Minnesota Statutes, section 342.02, subd. 1. <br />112 <br />113 (E)“Ordinance” means this interim ordinance, which is adopted pursuant to <br />114 Minnesota Statutes, section 342.13(e) and Minnesota Statutes, section <br />115 462.355, subdivision 4. <br />116 <br />117 Section 3. Study Authorized. The City Council hereby authorizes and directs City staff <br />118 to conduct a study regarding the adoption or amendment of reasonable restrictions on the <br />119 time, place, and manner of the operation of Cannabis Businesses, as well as other <br />120 potential local regulations allowed under the Act, and report to the City Council on the <br />121 potential regulation of Cannabis Businesses. The study may include a review of any <br />122 model ordinances that OCM is directed to draft under Minnesota Statutes, section <br />123 342.13(d), an analysis of potential setback regulations allowed under Minnesota Statutes, <br />124 section 342.13(c), and such other matters as staff may determine are relevant to the City <br />125 Council’s consideration of this matter. The report may also include City staff’s <br />126 recommendations on whether the City Council should adopt regulations and, if so, the <br />127 recommended types of regulations. <br />128 <br />129 Section 4. Moratorium. A moratorium is hereby imposed on the operation of a Cannabis <br />130 Business within the City. During the term of this Ordinance, no business, person, or <br />131 entity may establish or operate a Cannabis Business within the jurisdictional boundaries <br />132 of the City. Accordingly, during the period that this Ordinance is in effect, the City shall <br />133 not accept, process, or act on any application, site plan, building permit, zoning request, <br />134 or other approval, including any requested confirmation, certification, approval, or other <br />135 request from the OCM or other governmental entity requesting City review of any <br />136 application or proposal for a business proposing to engage in the operation of a Cannabis <br />RS160\\1\\957617.v4 <br />Qbhf!8!pg!88 <br /> <br />
