<br />REQUEST FOR COUNCIL ACTION <br />Date: 7/15/2024 <br />Item No.: 7.c. <br />Department Approval City Manager Approval <br /> <br /> <br />Item Description: Review Sales Tax Referendum Ballot Questions <br />1 <br />2 Background <br />3 On November 5, 2024, Roseville voters will consider two referendum questions on the <br />4 ballot regarding the creation of local sales tax of 0.5% that will be used to cover the costs of <br />5 constructing a new Parks and Public Works Maintenance Facility and License and Passport <br />6 Center. <br />7 <br />8 Minnesota Statute § 205.16 requires that the City Clerk provide to the County Auditor <br />9 written notice of a ballot question, including the title and language of the question, at least <br />10 84 days before the election, which in this case is on or before August 13, 2024. In order to <br />11 do so, the Council must determine both the ballot title and the question. A clerk, county <br />12 auditor, or appropriate governing body must provide a title for each question printed on the <br />13 ballot. The ballot title must be 10 words or less and must be approved by the City’s legal <br />14 counsel. Minn. R. 8250.1810, Subp. 10. According to caselaw, ballot language must clearly <br />15 state the issue and be written in language the average voter can understand. Finally, <br />16 regarding sales tax measures, Minn. Stat. § 297A.99, subd. 3 (a) says: <br />17 <br />18…Imposition of a local sales tax is subject to approval by voters of the political subdivision <br />19 at a general election. The election must be conducted at a general election within the two- <br />20 year period after the governing body of the political subdivision has received authority to <br />21 impose the tax. If the authorizing legislation allows the tax to be imposed for more <br />22 than one project, there must be a separate question approving the use of the tax <br />23 revenue for each project. Notwithstanding the authorizing legislation, a project that is not <br />24 approved by the voters may not be funded with the local sales tax revenue and the <br />25 termination date of the tax set in the authorizing legislation must be reduced proportionately <br />26 based on the share of that project's cost to the total costs of all projects included in the <br />27 authorizing legislation. <br />28 <br />29 The City Attorney has drafted two options for each ballot question for the City Council to <br />30 review and consider. Option 1 just provides very basic information about the request. <br />31 Option 2 provides the basic information about the request but also describes what a "YES" <br />32 or "NO" vote means.
