<br /> <br />REQUEST FOR COUNCIL ACTION <br />Date: 8/5/2024 <br />Item No.: 10.f. <br />Department Approval City Manager Approval <br /> <br /> <br />Item Description: Approve Arvig Utility Easement <br />1 <br />2 Background <br />3 Arvig Enterprises (“Arvig”) has been working with the City to obtain an easement to install a <br />4 fiber line on Fairview Avenue near County Road C. Due to the limited county right-of-way in <br />5 this area, an easement from the City is needed since the City owns the parcel to the east. <br />6 Part of the turn lane and the sidewalk on the east side of Fairview Avenue are located <br />7 within the City parcel. Since this infrastructure is normally located in right-of-way, staff will <br />8 allow Arvig to utilize this area similar to right-of-way for utility purposes. To document the <br />9 use of this area, our attorney worked with Arvig to draft a utility easement. The five-foot <br />10 easement allows for Arvig to install their fiber line on the far west side of the City parcel <br />11 adjacent to County right-of-way. The use of the City parcel will not be affected. <br />12 <br />13 Policy Objectives <br />14 It is City policy to keep systems operating in a safe condition. <br />15 <br />16 Equity Impact Summary <br />17 There should be no equity impacts associated with this easement. <br />18 <br />19 Budget Implications <br />20 There are no costs for the easement. <br />21 <br />22 Staff Recommendations <br />23 Staff recommends the City Council approve the utility easement. <br />24 <br />25 Requested Council Action <br />26 Motion to approve utility easement with Arvig Enterprises. <br />27 <br />28 <br />Jesse Freihammer, Public Works Director <br />Prepared by: <br />1.
