Department Approval City Manager Approval Item Description: Approve the renewal of a short term rental license for 1277 Garden Avenue 1 2 Background 3 Chapter 909 of City Code requires the licensing of non-owner occupied short term rentals 4 of dwelling units, subject to certain exemptions. The original short term rental license for 5 1277 Garden Avenue was issued on September 13, 2022. On August 22, 2024, an 6 application for renewal of the short term rental license was submitted by the property 7 owner. The property is a four-bedroom, single family home. The property owner has 8 certified and attested to the requirement of lodging tax payment, as well as, the maximum 9 occupancy of four or less unrelated adults or one family. The subject property’s current 10 short term rental license is valid through September 13, 2024. There have been no 11 nuisance or property maintenance violations confirmed during the current license period. 12 Lodging tax payments have been made for October and November 2023. Short term 13 rentals licenses include the requirement of minimum stays based on on-season (10 days) 14 and off-season (7 days) times of the year. This property is one of eight licensed short term 15 rentals within the City. 16 17 Upon renewal, the license will be valid for 365 days from the expiration date of the current 18 license. A current copy of the license must be posted in the rental unit, along with current 19 copies of City Code Sections 405, 407 and 602. Within ten days of Council approval, all 20 residential properties of one to four units within 300 feet must be provided a copy of the 21 City issued license. A draft of the license is provided as Attachment 2. 22 23 The applicant has supplied all required license information and paid the license fee of 24$515. In accordance with Section 909.03, the process for licensure is outlined in Chapter 25 301, which requires presentation to the City Council. Based upon the requirements 26 outlined in the ordinance, the property owner is entitled to the license. 27 28 Policy Objectives 29 Licensing required by Section 909, effective as of February 8, 2021. 30 31 Equity Impact Summary 32 Staff has not identified any equity impacts related to this action. 33 34 Budget Implications 35 The correct fees were paid to the City at the time of application submittal.
