REQUEST FOR COUNCIL ACTION
Date: 11/25/2024
Item No.: 7.d.
Department Approval City Manager Approval

Item Description: Consider a request to perform an abatement for unresolved violations of City
Code at 2165 Victoria St N

Background
The subject property is an un-occupied, single family home. Current violations related to the abatement
request include (applicable code sections noted in parentheses):
Twelve Inoperable vehicles (407.02.G, 407.04.D)
Numerous vehicles without current registration (407.02.G, 407.04.D)
Outside storage of miscellaneous items, including a tire, battery, and vanity top (407.03.I)

Staff conducted an inspection and confirmed these violations on October 22, 2024. Staff sent invoices
for Administrative Citations and Repeat Nuisance fees on October 24, 2024 given this property was the
subject of a City Council approved abatement on June 5, 2023, with the actual abatement of inoperable
and unlicensed vehicles performed on June 16, 2023. Regarding the current violations, staff performed
a follow-up inspection on November 1, 2024, which revealed no progress toward compliance related to
the unlicensed and inoperable vehicles or outside storage of materials. A letter was mailed to the
property detailing the violations and a timeframe for correction. Another inspection was conducted a
week later, on November 7, 2024, where again, no progress towards compliance was observed. A
property representative called staff on November 7th to state that he was in receipt of the notices and
would have the property brought into compliance prior to any Council action. On November 15, 2024,
staff again inspected the property. Upon observing no progress, staff posted a notice of a City Council
request to perform an abatement on the front door of the residence. Previous citations, repeat nuisance
fees and related city correspondence related to these actions are provided in Attachment 4.

As of the writing of this Request for Council Action, no progress towards code compliance with any
noted violations have been observed on this property. A status update will be provided during the
hearing.

Policy Objectives
The abatement of public nuisances is necessary to protect the public's comfort, repose, health and
safety.

Equity Impact Summary
Equity impacts related to this request have not been evaluated.

Budget Implications
The estimated costs of the proposed abatement include the following:
Qbhf!66!pg!745
