<br />REQUEST FOR COUNCIL ACTION <br />Date: 4/7/2025 <br />Item No.: 10.g. <br />Department Approval City Manager Approval <br /> <br /> <br />Item Description: Approve the renewal of a Short-Term Rental License for 419 Judith <br />Avenue W <br />1 <br />2 Background <br />3 Chapter 909 of City Code requires the licensing of non-owner-occupied short term rentals of dwelling <br />4 units, subject to certain exemptions. On February 6, 2025, an application for a short term rental license <br />5 was submitted by the property owner (Attachment 1). The property is a four-bedroom, single family <br />6 home. The property owner has certified and attested to the requirement of lodging tax payment, as well <br />7 as, the maximum occupancy of four or less unrelated adults or one family. City records indicate there <br />8 have been no nuisance or property maintenance violations during the last license period. Staff has <br />9 verified there are no other licensed short-term rental properties within 500 feet of this property. Short <br />10 term rental licenses include the requirement of minimum stays based on on-season (10 days) and off- <br />11 season (7 days) times of the year. <br />12 <br />13 Upon issuance, the license will be valid for 365 days and will require notification to residential properties <br />14 within 300 feet of the subject property. If approved, this property will be one of ten properties with a <br />15 current short term rental license. A copy of the license must be posted in the rental unit, along with <br />16 copies of City Code Sections 405, 407 and 602. A draft of the license is provided as Attachment 2. <br />17 <br />18 The applicant has supplied all required license information and paid the license fee of $540.00. In <br />19 accordance with Section 909.03, the process for licensure is outlined in Chapter 301, which requires <br />20 presentation to the City Council. Based upon the requirements outlined in the ordinance, the property <br />21 owner is entitled to the license. <br />22 <br />23 Policy Objectives <br />24 Licensing is required by Section 909, effective as of February 8, 2021 and most recently revised on <br />25 February 12, 2024. The purpose of the license is to ensure that non-owner-occupied short-term rentals <br />26 of dwelling units is conducted, operated, and maintained so as not to become a nuisance to the <br />27 surrounding neighborhood or an influence that fosters blight and deterioration or creates a disincentive <br />28 to reinvest in the community. The operation of a short-term rental property is a business enterprise that <br />29 entails responsibilities required of the owner, local agent, and guests. <br />30 <br />31 Equity Impact Summary <br />32 Staff has not identified any equity impacts related to this action. <br />33 <br />34 Budget Implications <br />35 The correct fees were paid to the City at the time of application submittal. <br />36 <br />37 Staff Recommendations <br />38 Staff recommends approval of a one year Short-Term Rental License for 419 Judith Avenue W. <br />Page 1 of 2 <br />Qbhf!:7!pg!231 <br /> <br />
