<br />REQUEST FOR COUNCIL ACTION <br />Date: 5/5/2025 <br />Item No.: 7.b. <br />Department Approval City Manager Approval <br /> <br /> <br />Item Description: Consider a request to perform an abatement for unresolved violations of City <br />Code at 795 Cope Avenue W <br />1 <br />2 Background <br />3 The subject property is an occupied, single family home. Current violations related to the abatement <br />4 request include: <br />5 Inoperable vehicle (407.02.G) <br />6 Vehicle stored on unimproved surface (407.04.D) <br />7 Vehicle without current registration (407.02.G, 407.04.D) <br />8 This property has been notified of City Code violations on 01/30/25, 02/10/25, and 04/18/25 (Attachment <br />9 3). Site visits and inspections were conducted prior to each notice being mailed or delivered <br />10(Attachment 1). Staff received communication from the property owner by phone on February 18, March <br />11 24 and March 28, 2025 requesting an extension to the end of June 2025, stating that she understood the <br />12 violations and had plans for the correction. Staff has been unwilling to extend the compliance deadline <br />13 to the end of June given our typical compliance timeframe for these violations is ten days and the owner <br />14 has already been given nearly 90 days. To-date compliance has not been observed. A final notice was <br />15 posted on the property detailing the violations and notification of the Council hearing date of May 5, 2025 <br />16(Attachment 3). <br />17 <br />18 As of the writing of this RCA, no progress related to any noted violations has been observed on this <br />19 property. The property owner did contact the Community Development Director on April 28th, indicating <br />20 she felt she had not been given adequate notice and was unaware of the City Council date where the <br />21 abatement action would be considered. The Community Development Director informed the property <br />22 owner she had already been given a compliance timeframe well beyond what is customary, that the City <br />23 Council meeting date would be May 5, 2025, and the City Council could consider additional time for <br />24 compliance at the hearing.
