<br />REQUEST FOR COUNCIL ACTION <br />Date: 5/19/2025 <br />Item No.: 7.b. <br />Department Approval City Manager Approval <br /> <br /> <br />Item Description: Consider a request to perform an abatement for unresolved violations of City <br />Code at 2941 Victoria Street N <br />1 <br />2 Background <br />3 The subject property is an occupied, single family home. Current violations related to the abatement <br />4 request include (applicable code sections provided in Attachment 3): <br />5 Unsafe structure (1300.0180, 906.03.H) <br />6 Parking on unimproved surface (407.02.G.4.a) <br />7 Outside storage of miscellaneous items (407.03.I) <br />8 Unlicensed and inoperable vehicle (407.04) <br />9 <br />10 Staff received a complaint regarding a tent structure constructed at the subject address on September <br />11 30, 2024. Staff confirmed violations during a site visit. Staff were able to speak with a person at the <br />12 property on September 30, 2024. Staff were assured that all violations would be corrected as soon as <br />13 the inoperable vehicle underneath the tent was repaired. On October 28, 2024, staff received a <br />14 voicemail from the property owner requesting more time to make corrections. Staff followed up on <br />15 November 13, 2024 with a voicemail and letter requesting a definitive timeframe for corrections. Staff <br />16 conducted a site visit on December 12, 2024 to discuss the violations with the property owner. The <br />17 property owner stated that the tent, the inoperable vehicle and all items stored outside belonged to his <br />18 adult daughter and that he has had numerous conversations with her about correcting all noted <br />19 violations. Staff continued to work with the property owner and together an agreed-upon date for full <br />20 compliance would occur no later than May 1, 2025. On May 9, 2025 staff posted a condemnation <br />21 placard on the unsafe structure and provided notice of the scheduled Council hearing where staff would <br />22 request the abatement of violations. A compressed timeline of staff interactions is included in <br />23 Attachment 1. Staff correspondence and photos of violations are included in Attachment 2. <br />24 <br />25 As of the writing of this Request for Council Action, no progress towards code compliance with any <br />26 noted violations has been observed on this property.
