<br /> <br />REQUEST FOR COUNCIL ACTION <br />Date: 5/19/2025 <br />Item No.: 7.c. <br />Department Approval City Manager Approval <br /> <br /> <br />Item Description: Consider Presumptive Penalty Approval - 2025 Alcohol Compliance <br />Check (La Casita) <br />1 <br />2 Background <br />3 In 2025, all businesses holding a City of Roseville liquor license received a letter in the spring <br />4 announcing that two citywide alcohol compliance checks would be conducted before the end of the <br />5 calendar year (Attachment 1). The letter also included information regarding the Roseville City <br />6 Ordinance mandating a liquor licensee training program and outlining penalties for noncompliance. <br />7 This report pertains to the first round of alcohol compliance checks, conducted in March 2025. <br />8 On March 29, 2025, an underage compliance checker entered various establishments licensed to sell <br />9 alcohol in Roseville to conduct compliance checks. Following the checks, multiple businesses were <br />10 found to be noncompliant (Attachment 2). <br />11 La Casita (Case #25009396) <br />12 An underage checker ordered alcohol from an employee. The employee asked for identification but <br />13 ultimately served alcohol to the underage checker. The employee was issued an administrative <br />14 citation, which has since been paid. <br />15 This incident marks La Casita’s second on-sale violation within a 36-month period; the previous <br />16 violation occurred on August 12, 2023 (RV Case #23023413). <br />17 Officers met in person with each noncompliant business to advise them of the upcoming Roseville <br />18 City Council hearing date. This notice was also provided in writing (Attachment 3). La Casita has <br />19 since submitted the required training documentation for its staff. <br />20 <br />21 <br />22 Policy Objectives <br />23 The Roseville Police Department seeks Council approval to issue and administer the presumptive <br />24 penalty pursuant to City Code Section 302.15, for on-sale license holders for the second violation within <br />25 thirty-six (36) months. The mandatory minimum penalty shall be a two thousand dollar ($2,000.00) fine <br />26 and five day liquor license suspension. <br />27 <br />28 Equity Impact Summary <br />29 Upon review of any potential racial equity impacts, staff notes that the citywide compliance checks, <br />30 subsequent fines, and suspensions are uniform and written into the city code.
