<br /> <br />REQUEST FOR COUNCIL ACTION <br />Date: 5/19/2025 <br />Item No.: 7.g. <br />Department Approval City Manager Approval <br /> <br /> <br />Item Description: Consider Presumptive Penalty Approval - 2025 Tobacco Compliance <br />Check (Noble Tobacco) <br />1 <br />2 Background <br />3 In 2025, all businesses holding a City of Roseville tobacco license received a letter in the spring <br />4 announcing that two citywide compliance checks would be conducted before the end of the calendar <br />5 year (Attachment 1). <br />6 This report pertains to the first round of compliance checks, conducted in March 2025. <br />7 On March 29, 2025, an underage compliance checker entered various establishments licensed to sell <br />8 tobacco in Roseville to conduct compliance checks. Following the checks, multiple businesses were <br />9 found to be noncompliant (Attachment 2). <br />10 Noble Tobacco (Case #25009319) <br />11 An underage checker ordered tobacco from an employee. The employee asked for identification but <br />12 ultimately provided tobacco to the underage checker. The employee was issued an administrative <br />13 citation, which has since been paid. <br />14 This incident marks Noble Tobacco’s second sale violation within a 36-month period; the previous <br />15 violation occurred on August 11, 2023 (RV Case #23023244). <br />16 Officers met in person with each noncompliant business to advise them of the upcoming Roseville <br />17 City Council hearing date. This notice was also provided in writing (Attachment 3). <br />18 <br />19 <br />20 Policy Objectives <br />21 The Roseville Police Department seeks Council approval to issue and administer the presumptive <br />22 penalty pursuant to City Code Section 306.09, for tobacco products - license holders for the second <br />23 violation within thirty-six (36) months. The mandatory minimum penalty shall be a two-thousand dollar <br />24($2,000.00) fine and three-day tobacco license suspension. <br />25 <br />26 Equity Impact Summary <br />27 Upon review of any potential racial equity impacts, staff notes that the citywide compliance checks, <br />28 subsequent fines, and suspensions are uniform and written into the city code. At this time, staff did not <br />29 identify a disproportionate racial equity impact.
