March 7, 2025 <br />ATTN: MANAGER <br />Please thoroughly review the following information as it pertains to tobacco compliance checks <br />conducted by the Roseville Police Department. <br />Please review the state statute relating to sales of tobacco products to underage persons: <br />Minnesota Statute Chapter 609.685 SALE OF TOBACCO TO PERSONS UNDER AGE 21 <br />Subdivision. 1a. Penalty to sell or furnish. (a) Any person 21 years of age or older who <br />sells, gives, or otherwise furnishes tobacco, tobacco-related devices, or electronic delivery <br />devices to a person under the age of 21 years is guilty of a petty misdemeanor for the first <br />violation. Whoever violates this subdivision a subsequent time within five years of a <br />previous conviction under this subdivision is guilty of a misdemeanor. <br />The civil penalties for underage tobacco sales are set forth in the Roseville City Code. These <br />penalties vary depending upon whether it is a first time violation, a second time violation, a third <br />time violation, etc. The mandatory minimum penalty (imposed upon the licensee) for the <br />sale of tobacco products to underage individuals is a $1,000 fine. <br />These penalties are civil in nature. Please be aware criminal penalties may also be imposed for <br />violations of the Ordinance. <br />The Roseville Police Department will conduct a minimum of two citywide compliance checks in <br />2025. Please remind your employees of their legal and moral responsibility not to sell tobacco <br />products to anyone under the age of 21. <br />Once again, we encourage you to review Roseville City Code, Chapter 306.
