<br /> <br />REQUEST FOR COUNCIL ACTION <br />Date: 6/16/2025 <br />Item No.: 7.b. <br />Department Approval City Manager Approval <br /> <br /> <br />Item Description: Consider Approval of Aldine ROW Vacation <br />1 <br />2 Background <br />3 At the April 21, 2025 City Council meeting, the council tabled vacation area V, the proposed <br />4 vacation of Aldine right-of-way (ROW) between Roselawn Avenue and Ryan Avenue. <br />5 <br />6 At the previous council meeting, the right-of-way was understood to include a 30-foot <br />7 easterly portion, dedicated through the Mid Oaks plat in 1938, and a 20-foot westerly <br />8 portion that appeared to have been established through condemnation proceedings in <br />9 1951. Because there was no clear record of the condemnation being formally recorded, the <br />10 proposed vacation resolution presented to the City Council included language to vacate the <br />11 20-foot westerly portion out of an abundance of caution, essentially functioning as a quit- <br />12 claim action to release any potential interest the City may have had. <br />13 <br />14 Following the public hearing, further investigation was conducted by staff and the adjacent <br />15 property owners in coordination with the Ramsey County Recorder’s Office. This effort <br />16 confirmed that no right-of-way or easement over the western 20 feet was ever recorded <br />17 and, as such, the City does not legally hold right-of-way over that portion of land, and it is <br />18 considered private property. Consequently, only the 30-foot easterly portion of the corridor <br />19 is public right-of-way. County/City GIS data has been updated to reflect this clarified status. <br />20 Based on this determination, the vacation is only considering vacating the 30-foot easterly <br />21 portion as dedicated in the Plat of Mid Oaks. <br />22 <br />23 Based on feedback from Council, staff developed a feasibility memo (Attachment 6) on the <br />24 ROW corridor and if a pathway could be installed. The memo documents that a pathway, <br />25 either a concrete sidewalk or a bituminous trail, could be installed within the ROW. Based <br />26 on the current 30 feet of ROW, there would be adequate room to install a pathway but there <br />27 would be significant impact to trees due to necessary grading. The pathway would be 590 <br />28 feet in length and provide a trail connection at a ¼ mile spacing instead of the ½ mile <br />29 spacing between Fairview and Snelling. A pathway would provide shorter connections <br />30 between neighborhoods and the Roselawn pathway. Without the connection, the walk is <br />31 approximately 1,900 feet (~3.3x) further via Fairview Avenue or approximately 2,700 feet <br />32(~5x) further via Snelling Avenue. The cost to install a pathway would range from $84,000 <br />33 to $177,000 plus additional costs for crosswalk treatments if enhancements were <br />34 determined to be needed.
