<br /> <br />REQUEST FOR COUNCIL ACTION <br />Date: 7/21/2025 <br />Item No.: 7.c. <br />Department Approval City Manager Approval <br /> <br /> <br />Item Description: Consider Approval of Aldine ROW Vacation <br />1 <br />2 Background <br />3 At the June 16, 2025 City Council meeting, the Council considered the City-initiated <br />4 proposed vacation of Aldine right-of-way (ROW) between Roselawn Avenue and Ryan <br />5 Avenue, but took no action. After the meeting on June 16, 2025, adjacent residents to this <br />6 ROW signed a valid petition to vacate the ROW (Attachment 2). This changes the vote <br />7 required from a super majority vote (4/5ths) to a simple majority vote (3/5ths). Since this is <br />8 now a petitioned vacation request, a new mailing notice was sent out and a new public <br />9 hearing is required. <br />10 <br />11 As indicated at the previous Council meeting, the right-of-way to be vacated is only the 30- <br />12 foot ROW that was dedicated through the Plat of Mid Oaks in 1938. The Ramsey County <br />13 Recorder’s Office confirmed that the 20 feet west of the Aldine right-of-way where city <br />14 utilities are located is private property. Attachment 8 is a survey exhibit that the City’s <br />15 surveyor completed after the last Council meeting. It shows where the City ROW is, where <br />16 the informal pathway is located in relation to the ROW, and where City utilities are. The <br />17 survey confirms that much of the existing pathway is on private property. As indicated <br />18 previously, the City will likely need to acquire utility easements at a future date from two <br />19 property owners. <br />20 <br />21 As discussed at the June 16 meeting, staff developed a feasibility memo (Attachment 6) on <br />22 the ROW corridor to see if a pathway could be installed. The memo documents that a <br />23 pathway, either a concrete sidewalk or a bituminous trail, could be installed within the <br />24 ROW. Based on the current 30 feet of ROW, there would be adequate room to install a <br />25 pathway but there would be significant impact to trees due to necessary grading. The <br />26 pathway would be 590 feet in length and provide a trail connection at a ¼ mile spacing <br />27 instead of the ½ mile spacing between Fairview and Snelling. A pathway would provide <br />28 shorter connections between neighborhoods and the Roselawn pathway. Without the <br />29 connection, the walk is approximately 1,900 feet (~3.3x) further via Fairview Avenue or <br />30 approximately 2,700 feet (~5x) further via Snelling Avenue. The cost to install a pathway <br />31 would range from $84,000 to $177,000 plus additional costs for crosswalk treatments, if <br />32 enhancements were determined to be needed. Based on Pathway Master Plan scoring <br />33 criteria, the preference points are 7.
