Staff have provided a map illustrating how many properties are <br />37 potentially impacted by such regulations (Attachment 4), which range from 200-600. <br />38 <br />39 Lastly, as is customary with any new policy, program or initiative, the Equity & Inclusion <br />40 Toolkit was completed to help guide decision-making. The completed toolkit is provided as <br />41 Attachment 5, which includes greater details on desired outcomes, benefits and burdens, <br />42 unintended consequences, and engagement efforts surrounding the new regulations. <br />43 <br />44 Staff will provide a presentation (Attachment 6) outlining the issue, options for ordinance <br />45 language, and other issues related to the scope of the issue/ordinance. Staff seeks <br />46 feedback from the Council on the proposed ordinance language (Attachment 3) and/or <br />47 whether the Council desires to further limit the scope of the ordinance, and if so, how. If <br />48 the Council is interested in proceeding further, staff would prepare an ordinance for <br />49 consideration at a future City Council meeting. <br />50 <br />51 Policy Objectives <br />52 Regulations governing the construction of structures are to ensure public health, safety, <br />53 and welfare insofar as they are affected by the continued occupancy and maintenance of <br />54 structures and premises. <br />55 <br />56 Equity Impact Summary <br />57 The proposed ordinance is the product of a request from residents who reside in a 20-unit <br />58 detached town home development that is under construction and results in homes having <br />59 10' setbacks. These residents have concerns their homes will not be adequately protected <br />60 from excavation activities for the future homes in the development. The ordinance would <br />61 impose close-proximity building regulations to ensure vertical and/or lateral support for <br />62 existing foundations is provided during excavation activities that occur within 10' of another <br />63 structure/building, as the existing Residential Building Code does not require such <br />64 protections when on-site threats are not obvious or apparent. The impact of the ordinance <br />65 has the possibility to be widespread given the interior side yard setback requirement in the <br />66 LDR, LMDR and MDR zoning districts is 5', however the actual impacts will be dependent <br />67 on the conditions under which the ordinance would be applied, the specific characteristics <br />68 of individual projects, the surrounding landscape, and legal property boundary <br />69 considerations.
