REQUEST FOR COUNCIL ACTION <br />Date: 10/13/2025 <br />Item No.: 7.a. <br />Department ApprovalCity Manager Approval <br />Item Description:Consider a request to perform an abatement for unresolved violations of City <br />Code at 949 Brooks Avenue West <br />1 <br />2 Background <br />3 The subject property is an occupied, single-family home. Current violations related to the abatement <br />4 request include: <br />5 Outside storage of inoperable vehicles, Junk (407.02.G, 407.03.I 407.04.A,D) <br />6 Staff received a complaint regarding vehicles, household and other items stored outside this residence <br />7 on August 20, 2025. Staff visited the property and confirmed the violation. A door hanger was left on site <br />8 detailing the violations and a timeline for correction. Staff conducted an additional inspection on <br />9 September 2. Staff found no corrections or progress. A letter was drafted and sent to the property on <br />10 September 10. A subsequent inspection was performed on September 19, 2025, staff was able to make <br />11 contact and speak with the resident. He stated that he would register the vehicles and remove the items <br />12 stored outside before the council hearing. Staff hand delivered a notification of the Council hearing date. <br />13 On October 3, staff conducted an additional inspection to verify if the resident was able to make any <br />14 progress or corrections, but none were observed. Staff posted an additional notification of the Council <br />15 hearing on the property, as well as the inoperable vehicles. Staff learned on October 7 that the property <br />16 had changed ownership. Staff contacted the new owner to ensure that he was aware of the upcoming <br />17 Council hearing. He stated he was not aware and would make sure the vehicles were properly <br />18 registered or removed from the property and that the junk/debris would also be removed prior to the <br />19 Council hearing. He stated that he was appreciative of being contacted regarding these concerns. A <br />20 timeline of staff's actions is included with this report in Attachment 2, cited City Code sections are <br />21 provided as Attachment 3, and staff correspondence and photos are included in Attachment 4. <br />22 <br />23 As of the writing of this Request for Council Action, no progress related to any noted violation or code <br />24 compliance has been observed on this property.
