<br />REQUEST FOR COUNCIL ACTION <br />Date: 10/20/2025 <br />Item No.: 7.c. <br />Department ApprovalCity Manager Approval <br />Item Description:Consider an Ordinance Adopting and Enacting a New City Code <br />1 <br />2 Background <br />3 The City has been engaged in a comprehensive recodification of the City Code. This process began in <br />4 2022 with staff research on codification service providers, and on April 24, 2023, Council approved a <br />5 contract with Municode for recodification, supplementation, and online hosting of our City Code. Since <br />6 that time, staff, the City Attorney and attorneys from Municode have been reviewing, researching and <br />7 editing the final city code. <br />8 <br />9 Recodification modernizes the code's organization and legal conformity. The process was a detailed, <br />10 multi-stage project designed to streamline, and legally align our ordinances. The project included a full <br />11 legal review to ensure consistency with state statutes, identification and removal of obsolete or <br />12 conflicting provisions, and preparation of the Code for online hosting with enhanced functionality such as <br />13 advanced search features, translation, and gender-neutralization options. This process consolidated <br />14 duplicate sections, corrected outdated citations, and cleaned up style/numbering for clarity and future <br />15 maintenance. No substantive changes have been made to the code. Staff and the City Attorney have <br />16 identified areas where changes may be needed, however, those items will come to council for full review <br />17 and consideration at separate times. <br />18 <br />19 For context, the following stages were part of the recodification process: <br />20 Materials collection and initial organization All ordinances were compiled, normalized to <br />21 Municode's format, and arranged into a draft Code structure. Adoption dates were recorded for <br />22 history notes. <br />23 Legal Review – A Code Attorney conducted a statute-level analysis to flag conflicts/obsolete <br />24 text and recommend fixes (e.g. update or adopt state definitions by reference, remove repealed <br />25 statute references, consolidate duplicative provisions). These recommendations appeared as <br />26 strike-throughs (deletions), underlines (additions), and explanatory footnotes in the Code <br />27 Attorney's first rough draft. <br />28 Conference – Staff worked with Municode and the City Attorney to confirm recommendations <br />29 and set a cut-off date; ordinances adopted after that date will be queued for the first Supplement. <br />30 Post-Conference Follow-Up Staff responded to outstanding questions and continued to <br />31 submit newly adopted ordinances. <br />32 Implementation, Editing, and Proofreading Municode’s editorial team incorporated changes, <br />33 styled and numbered the Code, and provided draft proofs for staff review. <br />34 Final Printing and Adoption Ordinance The final Code was prepared and is now ready to be <br />35 adopted by ordinance.
