Attachment 2 <br />1 City of Roseville <br />2 ORDINANCE NO. <br />3 <br />4 <br />5 AN ORDINANCE GRANTING TO NORTHERN STATES POWER COMPANY, A <br />6 MINNESOTA CORPORATION, ITS SUCCESSORS AND ASSIGNS, A <br />7 NONEXCLUSIVE FRANCHISE TO CONSTRUCT, OPERATE, REPAIR AND <br />8 MAINTAIN FACILITIES AND EQUIPMENT FOR THE TRANSPORTATION, <br />9 DISTRIBUTION, MANUFACTURE AND SALE OF GAS ENERGY FOR PUBLIC <br />10 AND PRIVATE USE AND TO USE THE PUBLIC GROUND OF THE CITY OF <br />11 ROSEVILLE, MINNESOTA, FOR SUCH PURPOSE; AND, PRESCRIBING <br />12 CERTAIN TERMS AND CONDITIONS THEREOF. <br />13 <br />14 THE CITY OF ROSEVILLE ORDAINS: <br />15 <br />16 SECTION 1.DEFINITIONS. <br />17 <br />18 For purposes of this Ordinance, the following capitalized terms listed in alphabetical order <br />19 shall have the following meanings: <br />20 <br />21 City. The City of Roseville, County of Ramsey, State of Minnesota <br />22 <br />23 City Utility System.Facilities used for providing public utility service owned or operated <br />24 by the City or an agency thereof, including sewer, storm sewer, water service, street lighting <br />25 and traffic signals, but excluding facilities for providing heating, lighting, or other forms of <br />26 energy. <br />27 <br />28 Commission.The Minnesota Public Utilities Commission, or any successor agency or <br />29 agencies, including an agency of the federal government, which preempts all or part of the <br />30 authority to regulate gas retail rates now vested in the Minnesota Public Utilities <br />31 Commission. <br />32 <br />33 Company. Northern States Power Company, a Minnesota corporation, its successors and <br />34 assigns including all successors or assigns that own or operate any part or parts of the Gas <br />35 Facilities subject to this franchise. <br />36 <br />37 Gas Facilities.Gas transmission and distribution pipes, lines, ducts, fixtures, and all <br />38 necessary equipment and appurtenances owned or operated by the Company for the purpose <br />39 of providing gas energy for public or private use. <br />40 <br />41 Notice. A writing served by any party or parties on any other party or parties. Notice to the <br />42 Company shall be mailed toGeneral Counsel, 414Nicollet Mall, 401-8, Minneapolis, MN <br />43 55401.Notice to the City shall be mailed to the City Manager, 2660 Civic Center Drive, <br />44 Roseville, Minnesota, 55113.
