REQUEST FOR COUNCIL ACTION
Date: 11/10/2025
Item No.: 7.b.
Department ApprovalCity Manager Approval
Item Description:Consider Presumptive Penalty Approval - 2025 Alcohol Compliance
Check (Chu Chao Liquor)

Background
In 2025, all businesses holding a city liquor license were provided a letter announcing two citywide
alcohol compliance checks to be conducted before the end of the calendar year (Attachment 1). The
letter included information on the Roseville City Ordinance regarding the mandatory liquor licensee
training program and penalties for noncompliance. The following summary pertains to the second round
of alcohol compliance checks conducted in September 2025.
On September 16, 2025, an underage compliance checker entered establishments in the City of
Roseville holding liquor licenses to conduct compliance checks. Upon conclusion of the checks, multiple
businesses failed (Attachment 2).
Chu Chao Liquors (CN 25029762): The underage checker selected an alcoholic beverage and brought
it to the counter. The employee did not check for identification and provided alcohol to the checker. The
employee was issued an administrative citation, which has since been paid. This marks Chu Chao's
second violation within 36 months (the previous violation occurred in October 2024).
Officers met with each business in person and advised them of the Roseville City Council hearing date.
This notification was also provided in writing (Attachment 3). Upon speaking with Chu Chao ownership, it
was learned that they were not up to date on the required training. They have since trained their staff
and have provided the documentation for this.

Policy Objectives
The Roseville Police Department seeks Council approval to issue and administer the presumptive
penalty pursuant to City Code Section 302.14, for off-sale license holders for the second violation within
thirty-six (36) months. The mandatory minimum penalty shall be a two thousand dollar ($2,000.00) fine
and a three (3) day suspension.

Equity Impact Summary
Upon review of any potential racial equity impacts, staff notes that the citywide compliance checks,
subsequent fines, and suspensions are uniform and written into the city code. At this time, staff did not
identify a disproportionate racial equity impact.

Budget Implications
Pursuant to City Code Section 302.14, the financial impact shall be a mandatory penalty of a two
Page 1 of 2
Qbhf!36!pg!74:
