REQUEST FOR COUNCIL ACTION <br />Date: 11/10/2025 <br />Item No.: 7.a. <br />Department ApprovalCity Manager Approval <br />Item Description:Conduct Public Hearing and Certify Unpaid Utility Charges to the <br />Property Tax Roll <br />1 <br />2 Background <br />3 As authorized by City Code, Sections 505, 801, 802, and 906, the City annually certifies to <br />4 the County Auditor any unpaid false alarms, water, sewer, and other charges that are in <br />5 excess of 90 days past due, for collection on the following year's property taxes. Affected <br />6 property owners are provided a hearing to dispute any charges against their property. <br />7 <br />8 Beginning in 2010, the City Council began approving certifications for delinquent utilities on <br />9 a quarterly basis. This ensures that any unpaid utilities are brought to the attention of new <br />10 property owners in a more timely fashion. It also allows the City to record a lien against the <br />11 property in the event that a property goes into foreclosure and/or is being prepared for sale <br />12 for other reasons. <br />13 <br />14 Attached is the current list of delinquent charges. Payments (along with accrued interest) <br />15 received in the Finance Office prior to October 31, 2025 were accepted and will not be <br />16 levied on the 2026 property taxes. <br />17 <br />18 Policy Objectives <br />19 Certifying delinquent charges are required under City Code <br />20 <br />21 Equity Impact Summary <br />22 While the process for certifying delinquent charges follows City Code and applies uniformly, <br />23 there could be equity impacts related to underlying causes of delinquency, such as income <br />24 disparities or barriers to accessing assistance programs. No analysis has been completed <br />25 to determine whether certain populations are disproportionately affected. <br />26 <br />27 Budget Implications <br />28 Certifying delinquent charges for collection on property taxes ensures recovery of unpaid <br />29 amounts owed to the City for utilities and other services.
