REQUEST FOR COUNCIL ACTION <br />Date: 11/10/2025 <br />Item No.: 7.c. <br />Department ApprovalCity Manager Approval <br />Item Description:Consider Presumptive Penalty Approval - 2025 Alcohol Compliance <br />Check (Red Lobster) <br />1 <br />2 Background <br />3 In 2025, all businesses holding a city liquor license were provided a letter announcing two citywide <br />4 alcohol compliance checks to be conducted before the end of the calendar year (Attachment 1). The <br />5 letter included information on the Roseville City Ordinance regarding the mandatory liquor licensee <br />6 training program and penalties for noncompliance. The following summary pertains to the second round <br />7 of alcohol compliance checks conducted in September 2025. <br />8 On September 17, 2025, an underage compliance checker entered establishments in the City of <br />9 Roseville holding liquor licenses to conduct compliance checks. Upon conclusion of the checks, multiple <br />10 businesses failed (Attachment 2). <br />11 Red Lobster (CN 25029908): The underage checker ordered an alcoholic beverage. The server <br />12 checked the underage ID and then provided alcohol to the checker. The server was issued an <br />13 administrative citation, which has not been paid. This marks Red Lobster's third violation within 36 <br />14 months (the previous violations occurred in March 2024 and December 2022). <br />15 Officers met with each business in person and advised them of the Roseville City Council hearing date. <br />16 This notification was also provided in writing (Attachment 3). To date, Red Lobster has not provided their <br />17 required training documentation for their staff. <br />18 <br />19 <br />20 Policy Objectives <br />21 The Roseville Police Department seeks Council approval to issue and administer the presumptive <br />22 penalty pursuant to City Code Section 302.14, for on-sale license holders for the third violation within <br />23 thirty-six (36) months. The mandatory minimum penalty shall be a two thousand dollar ($2,000.00) fine <br />24 and a fifteen (15) day suspension. <br />25 <br />26 Equity Impact Summary <br />27 Upon review of any potential racial equity impacts, staff notes that the citywide compliance checks, <br />28 subsequent fines, and suspensions are uniform and written into the city code.
