Attachment 2 1 City of Roseville 2 ORDINANCE NO. 3 4 5 AN ORDINANCE GRANTING TO NORTHERN STATES POWER COMPANY, A 6 MINNESOTA CORPORATION, ITS SUCCESSORS AND ASSIGNS, A 7 NONEXCLUSIVE FRANCHISE TO CONSTRUCT, OPERATE, REPAIR AND 8 MAINTAIN FACILITIES AND EQUIPMENT FOR THE TRANSPORTATION, 9 DISTRIBUTION, MANUFACTURE AND SALE OF GAS ENERGY FOR PUBLIC 10 AND PRIVATE USE AND TO USE THE PUBLIC GROUND OF THE CITY OF 11 ROSEVILLE, MINNESOTA, FOR SUCH PURPOSE; AND, PRESCRIBING 12 CERTAIN TERMS AND CONDITIONS THEREOF. 13 14 THE CITY OF ROSEVILLE ORDAINS: 15 16 SECTION 1. DEFINITIONS. 17 18 For purposes of this Ordinance, the following capitalized terms listed in alphabetical order 19 shall have the following meanings: 20 21 City. The City of Roseville, County of Ramsey, State of Minnesota 22 23 City Utility System. Facilities used for providing public utility service owned or operated by 24 the City or an agency thereof, including sewer, storm sewer, water service, street lighting and 25 traffic signals, but excluding facilities for providing heating, lighting, or other forms of energy. 26 27 Commission.The Minnesota Public Utilities Commission, or any successor agency or 28 agencies, including an agency of the federal government, which preempts all or part of the 29 authority to regulate gas retail rates now vested in the Minnesota Public Utilities Commission. 30 31 Company. Northern States Power Company, a Minnesota corporation, its successors and 32 assigns including all successors or assigns that own or operate any part or parts of the Gas 33 Facilities subject to this franchise. 34 35 Gas Facilities. Gas transmission and distribution pipes, lines, ducts, fixtures, and all necessary 36 equipment and appurtenances owned or operated by the Company for the purpose of 37 providing gas energy for public or private use. 38 39 Notice. A writing served by any party or parties on any other party or parties. Notice to the 40 Company shall be mailed to General Counsel, 414 Nicollet Mall, 401-8, Minneapolis, 41 Minnesota 55401. Notice to the City shall be mailed to the City Manager, 2660 Civic Center 42 Drive, Roseville, Minnesota 55113. Any party may change its respective address for the 43 purpose of this Ordinance by written notice to the other parties. 44 45 Public Ground.Land owned or otherwise controlled by the City for park, open space or 46 similar public purpose, which is held for use in common by the public and not a Public Way.
