Attachment 5 <br />39 Section 4. Surcharge. The City recognizes that the Minnesota Public Utilities <br />40 Commission may allow the Company to add a surcharge to customer rates of city <br />41 residents to reimburse the Company for the cost of the fee. The Company agrees <br />42 that it is prohibited from adding an administrative fee of any kind on to the <br />43 franchise fee. <br />44 Section 5. Enforcement. Any dispute, including enforcement of a default <br />45 regarding this ordinance will be resolved in accordance with Section 2.5 of the <br />46 Franchise Agreement. <br />47 Section 6. Effective Date of Franchise Fee. The effective date of fee collection <br />48 shall be March 1, 2026 or 90 days after the City sends written notice enclosing a <br />49 copy of this adopted Ordinance to the Company by certified mail, whichever date <br />50 is later. <br />51 Section 7. Effective Date.
