Attachment 2 <br />To: City Manager <br />From:Police Chief Erika Scheider <br />Date: January 19, 2025 <br />Re: Suggested updates to Immigration Policy <br />_____________________________________________________________________________________ <br />Background <br />On August 28, 2017, the Roseville City Council passed Resolution 11435 which directed that specific <br />language be incorporated into the Police Department policy governing immigration enforcement and <br />further required that language changes must be approved by the City Council. This directive has been <br />carried forward in our current policy manual under Policy 413.6 (formerly Policy 102). <br />The specific language adopted by the City Council in Resolution 11435 and in current policy is as follows: <br />Immigration and Customs Enforcement (ICE) <br />Federal law does not authorize the Roseville Police Department to enforce federal immigration laws. As <br />such, employees shall not inquire about a person’s immigration status unless it is directly related to a <br />criminal investigation. <br />Members of the department are authorized to assist ICE when it is related to scene safety and/or the <br />safety of ICE employees as they perform their duties. Members of the department are authorized to <br />cooperate with a task force involving ICE agents as long as the focus of the task force is not immigration <br />enforcement. <br />Members of the department will cooperate with ICE as specifically mandated by federal and state laws. <br />Consideration of Policy Update <br />Following recent immigration enforcement activity in Minnesota, as well as concerns brought forward <br />by members of our community, the Roseville Police Department conducted a review of several policies, <br />including Policy 413. While most updates did not change how the Roseville Police Department handles <br />immigration-related matters, language was revised to provide additional clarity to both officers and the <br />community regarding how the Department responds to calls involving immigration matters. <br />The section governed by Resolution 11435 (Section 413.6 Federal Requests for Assistance) was reviewed <br />in consultation with the City Attorney, with consideration of community feedback and current best <br />practices. The following language was drafted for Policy 413.6 and is proposed for Council approval: <br />Members shall not participate in immigration enforcement. As such, employees shall not inquire about a <br />person's immigration status unless it is directly related to a criminal investigation. <br />Qbhf!23!pg!269 <br /> <br />
