Attachment 2 <br />JL <br />1J� <br />Public Works Department <br />Memo <br />To: Public Works, Environment & Transportation Commission <br />From: Jesse Freihammer, Public Works Director <br />Date: January 26, 2026 <br />Re: Evaluation of Noise Ordinance Regarding Capital Improvement Projects <br />lia"'R MN <br />The purpose of this memorandum is to evaluate Roseville City Code Chapter 404 - Noise <br />Control (Chapter 404) as it applies to public capital improvement projects and to present <br />a recommended direction to Chapter 404 updates to allow limited administrative <br />flexibility for public construction activities occurring outside of current allowable <br />working hours. <br />I DEU OEM :Z110131, <br />Chapter 404 of the Roseville City Code establishes prohibitions on noise and limits <br />construction activities to defined working hours: weekdays 7:00 a.m. — 9:00 p.m., <br />weekends and legal holidays 9:00 a.m. — 9:00 p.m. Construction outside of these hours is <br />currently allowed only through narrowly defined exemptions for certain project types <br />(sewer lining projects, water main or valve replacements, high traffic areas) or by <br />obtaining a noise variance approved by the City Council following a public hearing. <br />While the existing framework provides predictability and public transparency, staff have <br />observed that the variance process, often requiring approximately 30 days, does not <br />always align with the practical realities of managing public capital improvement projects. <br />Contractors performing public projects, both for the City of Roseville and other public <br />agencies, may encounter circumstances where extended or adjusted working hours are <br />prudent, necessary, or in the public interest, but where the timing or duration does not <br />seem to justify a formal Council level variance. <br />• Page 1 <br />Page 40 of 84 <br />
