COMPARISON TO PEER CITIES <br />Staff reviewed noise and allowable construction hour ordinances from several <br />surrounding cities, including Arden Hills, Lauderdale, Shoreview, Maplewood, Richfield <br />and New Brighton. Common themes from these communities include: <br />All cities establish baseline allowable construction hour restrictions to protect <br />residential and neighborhood livability. <br />Several cities provide administrative authorization to grant short-term or limited <br />exceptions for public projects (Maplewood City Ordinance Sec. 18-111(d), <br />Richfield City Ordinance Sec. 930.35 Subd. 3)), often with notification <br />requirements, the ability to impose conditions to minimize impacts, and a process <br />to appeal to the City Council such decisions. <br />• Peer cities typically reserve City Council involvement for longer -duration, higher - <br />impact, or privately initiated requests. <br />The review demonstrates that providing defined administrative authorization for <br />reasonable variances to allowable working hours for capital improvement projects is <br />consistent with some surrounding cities' practices and supports efficient public project <br />delivery while maintaining accountability and transparency. <br />STAFF RECOMMENDEDATION <br />Staff recommends amending Chapter 404 to authorize the Public Works Director and/or <br />City Manager to approve limited exceptions to allowable construction hours for capital <br />improvement projects while setting reasonable conditions. <br />Key elements of the recommended approach include: <br />1. Applicability limited to publicly managed capital improvement projects, including <br />the City of Roseville, Ramsey County, etc. <br />2. Administrative authorization for exceptions that are short in duration or limited in <br />scope, with a maximum duration of 3 days. <br />3. Administrative authorization to set reasonable conditions to limit or minimize <br />noise impacts. <br />4. Maintain the requirement of advanced notification to affected residents and <br />businesses within 500 feet of the work, either conducted by the contractor or the <br />public agency (City, Ramsey County, etc.). <br />5. Retention of City Council approval for longer -duration or higher -impact <br />exceptions, as determined by Roseville City Code. <br />This approach aligns directly with operational needs of public capital projects, providing <br />the City with flexibility to respond to real world construction requirements while <br />preserving neighborhood livability and transparency. <br />• Page 3 <br />Page 42 of 84 <br />
