The exemption would be limited to less than three days of impact <br />35 outside of allowable working hours. Further, the request would need to show an overall <br />36 public benefit, such as unreasonable project delays or increased costs. Notification <br />37 requirements would still apply. <br />38 <br />39 Below are some fictional examples staff have come up with that would or would not be <br />40 allowed per the revised ordinance: <br />41 Staff would allow the night work per the revised ordinance with the 7-day notification: <br />42 o Ramsey County wants to perform night work to pave the intersection of <br />43 Fairview Avenue and County Road B to minimize traffic impacts near <br />44 Rosedale. <br />45 o Metropolitan Council wants to perform night work for one night to rehab a <br />46 manhole on North McCarrons since the work will take 24 hours to complete. <br />47 Staff would not allow the night work. A noise variance process and Council approval <br />48 would be required before night work is allowed: <br />49 o Ramsey County wants to perform night work to pave County Road C between <br />50 Rice Street and Lexington Avenue over a two-week period to minimize traffic <br />51 impacts. <br />52 o Acme Construction wants to extend work hours over the weekend from 6:00 <br />53 AM to 10:00 PM to expedite building demolition on Rice Street. <br />54 The Public Works Environmental and Transportation (PWET) Commission reviewed the <br />55 draft ordinance at their January 26, 2026 meeting and recommended approval of the <br />56 revised ordinance. <br />57 <br />58 Policy Objectives <br />59 It is City policy to keep City-owned infrastructure in good operating condition and to keep <br />60 systems operating in a safe condition. <br />61 <br />62 Equity Impact Summary <br />63 The overall goal of the ordinance change is to allow other public agencies the ability to get <br />64 noise exemptions for small public projects where there is an overall public benefit to do the <br />65 night work. The general public as a whole will benefit by streamlining the process which <br />66 can impact project time as well as save time and money for agencies.
