39 (3) This section 404.04 shall not apply to private construction activities. <br />40 (4) Any exemptions granted under this section 404.04 shall be subject to reasonable <br />41 conditions to minimize noise impacts and shall require advanced notice to <br />42 surrounding residents and businesses in accordance with Sec. 404.05 <br />43 (b) If work will be performed outside of normal working hours as described in section 404.03, <br />44 the city shall notify the residents/businesses within 500 feet of the project as far in advance as <br />45 practical. At minimum residents shall be notified seven days in advance of the work via a mailed <br />46 letter. The city manager, mayor and council shall also be notified. The letter, at minimum, shall <br />47 indicate the necessity of the work, schedule of the work, the scope of the work, the impacts and <br />48 the mitigation techniques that will be used to minimize impacts. <br />49 (Code 1995, § 405.035; Ord. No. 1548, 4-9-2018) <br />50 SECTION 2: Title 4, Section 404.05 of the Roseville City Code is amended to read <br />51 as follows: <br />52 <br />53 Sec. 404.05. - Noise variances. <br />54 Any person may apply to the city council for a variance from the requirements of this chapter prior <br />55 to doing those acts. The applicant shall provide a certified list of property owners within 350 500 <br />56 feet of the sites where the activity is to occur. The council procedure for public hearings shall be <br />57 as set forth in chapter 107. For good cause shown, the city council may, in its sole discretion, either <br />58 grant or deny the variance. If the variance is granted, the council may impose reasonable conditions <br />59 to it. <br />60 (Code 1995, § 405.04; Ord. No. 1175A, 11-25-1996) <br />61 SECTION 3:Incorporation. City staff is authorized and directed to update the table <br />62 of contents, reformat this ordinance, and to make such other non-substantive <br />63 changes, including correcting scrivener’s errors, as are necessary to incorporate the <br />64 amendments adopted by this ordinance into the Roseville City Code. <br />65 <br />66 SECTION 4: Effective date.
