REQUEST FOR COUNCIL ACTION <br />Date: 5/4/2026 <br />Item No.: 7.a. <br />Department ApprovalCity Manager Approval <br />Item Description:Convene as the Board of Adjustments and Appeals to consider an appeal by <br />Hempel Real Estate of the Variance Board's denial of a variance to Table 1013.01- <br />2, Minimum Number of Required Electric Vehicle Charging Stations (EVCS) and <br />§1013.04D(2)(d)(1) regarding the required number of Electrical Vehicle Service <br />Equipment (EVSE) required at 2700 Snelling Avenue <br />1 <br />2 Background <br />3 On March 20, 2023, the Roseville City Council adopted an ordinance approving Phase 2 amendments to <br />4 the Zoning Code. One component of this approval was the establishment of regulations concerning <br />5 electric vehicle charging stations (EVCS) and electrical vehicle service equipment (EVSE). These <br />6 requirements are contained in Table 1013.04-2 and 1013.04.D.2.d.1 of the Zoning Code. At the time of <br />7 adoption, Planning Division staff acknowledged the standards may need to be adjusted over time as the <br />8 ordinance gets implemented across various projects, as such standards were not commonplace at the <br />9 time of adoption, so there were uncertainties surrounding applicability given the variety of different <br />10 projects that would come forward. <br />11 Hempel Real Estate, in cooperation with 2700 Snelling Avenue LLC, applied for a variance seeking relief <br />12 from the requirements imposed by this ordinance. The variance consisted of a request to allow eight EV- <br />13 equipped (EVCS) stalls when 26 would normally be required and 22 EV-ready (EVSE) stalls when 53 <br />14 would normally be required. The required 26 EVCS and 53 EVSE stalls are based on the requirement to <br />15 provide 528 total parking stalls to serve a proposed 125,400 square foot medical office, research, and <br />16 laboratory facility at 2700 Snelling Avenue. The Request for Variance Board Action dated April 1, 2026 is <br />17 provided in Attachment 1, which included a staff recommendation and findings to approve the variance. <br />18 On April 1, 2026, the Roseville Variance Board received the staff report, presentations from staff and the <br />19 applicants, and held a public hearing. No public testimony was provided. The Variance Board <br />20 considered the staff recommendation to approve the request, as well as information provided from the <br />21 applicant regarding the practical difficulty preventing them from fully complying with the requirements of <br />22 the Zoning Code. After discussion amongst Variance Board members, the Board voted 2-1 to deny the <br />23 requested variances (see meeting minutes in Attachment 2). <br />24 <br />25 On April 1, 2026, the City Planner received an email from Hemple Real Estate seeking an appeal of the <br />26 Variance Board denial (Attachment 3). <br />27 <br />28 <br />29 Policy Objectives <br />30 The appeal process is outlined in Zoning Code Section §1009.08, which states the following: <br />Page 1 of 3 <br />Qbhf!7!pg!299 <br /> <br />
