<br />oral objections, and all written objections theretofore filed <br /> <br />with the City l'1anager were presented and considered, and all $uch <br /> <br />objections were tabulated as follows: A written communication <br />was received from Timothy P. Quinn of Meier, Kennedy & Quinn, <br />attorneys for Thechurch of Corpus Christi: The church objects <br />to the proposed special assessments for the improvements on the <br />grounds that the improvements do not result in any benefit to <br />the property owned by the church. The church requested that the <br />assessments for sanitary sewer, water and street be deferred until <br />such time as there shall be a hookup from the property now owned <br />by the church to the services provided by the improvements. <br /> <br />Oral presentations were made by the following: <br /> <br />MR. TIMOTHY P. QUINN, attorney for The Church of Corpus <br />Christi: A year ago the proposal to assess for sewer and water <br />was laid over in order to have the sewer, water and street assessed <br />at the same time. The objections the church made a year ago - <br />Exhibit A attached to the letter of September 4, 1974 - are the <br />same objections they still have. All of the property of the <br />church will be used for school and church purposes in the fore- <br />seeable future and there is no possibility in the foreseeable <br />future that it will be used in any other way. He said it appears <br />the city is assessing the property as though the highest and best <br />use and the intended use would 'be to divide it into lots which <br />isn't true because they have no intention of using it for that <br />purpose. Their position is that the church really doesn't get <br />any benefit from the improvements. They don't need the street, <br />sewer and water because they're served and have paid for these <br />services from other improvements. Mr. Quinn further said the <br />30 foot strip that will become the street has not yet been taken. <br />A year ago the church signed a waiver of trespass so the city <br />could go on the property and grade it and put in the sewer and <br />water and the street without any problem. No understanding has <br />been arrived at in regard to what the damages are to the church <br />for the 30 foot strip. They feel there are no benefits from the <br />improvements but that there are going to be some damages because <br />of the value of the street that's being taken. The church would <br />like to deed the property for the street to the city if there <br />would be no assessment to the church for the street. <br /> <br />MR. JULIUS LOIPERSBECK, 1023 Orchard: Indicated he would <br />be happy if the Council could cut the cost. <br />
