WHEREAS, on August 9, 2004 the City Council further authorized and directed staff to work with Rottlund Homes to further develop and refine for future Planning Commission and City Council consideration and action a redevelopment land use plan for Twin Lakes that includes a mixture of land uses including housing, office and retaiL WHEREAS, on August 9,2004 the City Council further approved the enactment of Ordinance No. 1309 entitled, tlAn Interim Ordinance Adopting a Development Moratorium for Properties located within the Twin Lakes Master Plan Area." WHEREAS, on September 20, 2004 the City Council held a public hearing to gain public comment regarding the public finance assistance for the redevelopment of Twin Lakes. WHEREAS, on September 27,2004 the City Council adopted a resolution indicating the Rottlund had achieved the activities associated outlined in the exclusive negotiation agreement by September 30, 2004 which was required to continue the agreement. WHEREAS, on Friday, October 22,2004, the Friends of Twin Lakes (Petitioner) submitted to the Environmental Quality Board (EQB) a Petition for an Environmental Assessment Worksheet (EA W Petition) pertaining to Phase I of the master planned project (the Project) proposed by the Rottlund Companies (Rottlund) in the general vicinity of County C, Cleveland, C-2, and Fairview Avenues in Roseville, Minnesota. WHEREAS, on Monday, October 25,2004, the EQB referred the EA W Petition to the City of Roseville for a decision as the Responsible Government Unit (RGU) under state law. WHEREAS, on November 8, 2004, pursuant to the advice of the City Attorney, the Roseville City Council adopted certain procedures for addressing the EA W Petition, which procedures included opportunities for written submissions by the Petitioner, Rottlund, and the general public, as well as a hearing process. WHEREAS, on November 22,2004, the City Council at its regular council meeting received testimony from the Petitioner, Rottlund, and city staff concerning their positions on the allegations raised by the Petition. 10
