<br />levels assumed in the ADAR. The Council determines that this allegation is <br />unsupported by the Record for the following reasons: <br /> <br />· As a threshold matter, Minn. Rules 4410.3610, subp. 7(C) does not require <br />the Rottlund proposal to mirror the mix of uses contained within the <br />AUAR. In a November 22,2004 e-mail, Gregg Downing of the EQB <br />advised the City Attorney that it would be appropriate for the City to <br />consider the differing impacts of the different blend of uses if sufficient <br />information allowed an appropriate comparison between the AUAR worst <br />case scenario assumed blend of uses, and the blend proposed by Rottlund - <br />the Council determines that sufficient information exists as discussed <br />below. <br /> <br />· The Rottlund blend of uses differs from the AUAR blend of uses in that the <br />Rottlund proposal contains 135% more housing and 38% more retail. <br />However, the Rottlund proposal also contains 85% less office use. <br /> <br />· The Rottlund proposal contains less total square footage of building than <br />the AUAR worst case scenario blend of development. <br /> <br />· The Rottlund proposal contains less impervious surface than the AUAR <br />worst case scenario blend of development. <br /> <br />· The Rottlund proposal includes more green space than the AUAR worst <br />case scenario blend of development. <br /> <br />· The Rottlund proposal contains less building mass than the AUAR worst <br />case scenario blend of development. <br /> <br />· The AUAR worst case scenario contemplated a big box retail center, and <br />the Rottlund proposal also contemplates a big box retail center. <br /> <br />· The AUAR worst case scenario contemplated development of a seven story <br />hospital south of Langton Lake; The Rottlund proposal contains buildings 4 <br />stories or less in height. <br /> <br />. The AUAR worst case scenario blend of uses included a 24 hour hospital, a <br />potential 24 hour fitness center, and other uses with typical hours of <br />operation beginning as early as 6:00 a.m. and ending as late as 2:00 a.m.; <br />The Rottlund proposal includes no 24 hour use, and most uses are limited to <br />the expected hours of 7 :00 a.m. to 11 :00 p.m. <br /> <br />13 <br />
