levels assumed in the ADAR. The Council determines that this allegation is
unsupported by the Record for the following reasons:

· As a threshold matter, Minn. Rules 4410.3610, subp. 7(C) does not require
the Rottlund proposal to mirror the mix of uses contained within the
AUAR. In a November 22,2004 e-mail, Gregg Downing of the EQB
advised the City Attorney that it would be appropriate for the City to
consider the differing impacts of the different blend of uses if sufficient
information allowed an appropriate comparison between the AUAR worst
case scenario assumed blend of uses, and the blend proposed by Rottlund -
the Council determines that sufficient information exists as discussed
below.

· The Rottlund blend of uses differs from the AUAR blend of uses in that the
Rottlund proposal contains 135% more housing and 38% more retail.
However, the Rottlund proposal also contains 85% less office use.

· The Rottlund proposal contains less total square footage of building than
the AUAR worst case scenario blend of development.

· The Rottlund proposal contains less impervious surface than the AUAR
worst case scenario blend of development.

· The Rottlund proposal includes more green space than the AUAR worst
case scenario blend of development.

· The Rottlund proposal contains less building mass than the AUAR worst
case scenario blend of development.

· The AUAR worst case scenario contemplated a big box retail center, and
the Rottlund proposal also contemplates a big box retail center.

· The AUAR worst case scenario contemplated development of a seven story
hospital south of Langton Lake; The Rottlund proposal contains buildings 4
stories or less in height.

. The AUAR worst case scenario blend of uses included a 24 hour hospital, a
potential 24 hour fitness center, and other uses with typical hours of
operation beginning as early as 6:00 a.m. and ending as late as 2:00 a.m.;
The Rottlund proposal includes no 24 hour use, and most uses are limited to
the expected hours of 7 :00 a.m. to 11 :00 p.m.

13
