10

As far as the people across the street, I can't see them wanting
to go for it at 100%. It just doesn't seem fair. Our impression
was that whenever a new development went in that the fellow who sold
it had to pay for the improvements on it and they were supposed to
be in before the people moved in so we feel the people are
getting kind of a shaft there.

The map doesn't picture it (inaudible) there is quite a jog
there. The third house across the street from us - a week ago
Saturday night had a bunch of people there for a party. I came
down Lovell and there were a bunch of cars here and there, and
one car pulled out in front of me. I had no where to go. I did
jam on the brakes and got out of his way but because of the
narrowness of the street it was a close one.

MR. ANDRE: You're generally in favor of the project but
have concern about the assessment for some of the people.

MAYOR DEMOS: Anyone else on this proposal? Anyone else
to be heard? If not, I will close the hearing.

COUNCILMAN KEHR: I would like to ask Mr. Popovich a
Is there some way, Mr. Popovich, that these people can be
more equitable assessment posture than what is here now.
are our options?

question.
assured a
What

MR. POPOVICH: You make a decision on assessments a year from
now. If you want to privately tell them how you're going to feel
that's your prerogative, but you can't bind the rest of the Council
and it may be that all of us won't be here a year from now so that's
one of the problems. Legally, we're here on the feasibility,
but you don't make assessment decisions tonight.

COUNCILMAN KEHR: It's very interesting the people that come up
and make comments. They're very much concerned about their
neighbors and I think that's very nice of them to be concerned
about their neighbors, and it appears as though the majority of the
people are in favor of the improvement. I just wanted to know what
our options were.

MAYOR DEMOS: Do you care to make a commitment?

COUNCILMAN KEHR: Not publicly at this time.

MR. POPOVICH: As this moves along, the City staff can look at
it and maybe something can be worked out. Obviously we don't want
this to happen in the future so perhaps something can be worked out
with the subdivider on the remaining lots.

COUNCIL~~ FRANKE:
feel and what we want to
not safe and it's better
developed.

I think the people in favor know how we
do, but by the same token the street is
to do it now than wait until you're more
