City Council MinutesPage 4 <br />January 13, 1986 <br />Johnson seconded, that the City <br />Matson moved, <br />Manager be instructed to send reports from <br />legal counsel regarding status of complaint <br />filed by Alvin Kehr against the City to all <br />Council members except Mr. Kehr.The Council <br />shall be provided copies of State Statutes <br />relative to conflict of interest. <br />Further the <br />City shall maintain an account for all expenses <br />incurred relating to the complaint. <br />Roll Call, <br />Matson, <br />Ayes:Cushman, Johnson, and Demos. <br />Nays:None.Abstain:Kehr. <br />E- 8 Demos moved, Johnson seconded, that the following <br />REFERRALS <br />items be referred to the February 5 Planning <br />Commission Meeting,and establishing the Council <br />Public Hearing for the meeting of February 10, <br />1986. <br />1. <br />Scott and Kathleen Elfstrom's request for <br />division of lot at 728 W. County Road C. <br />2. <br />Fairview Development Company request for <br />sign variance at 1928-48 West County Road C. <br />3.Ordinance amendment regarding the construction <br />of principal structures on major thoroughfares. <br />Turnaround driveways would be required to <br />eliminate the need to back into theright-of- <br />way. <br />Roll Call, Ayes: <br />Matson, <br />Cushman, Kehr, Johnson, <br />and Demos.Nays: <br />None. <br />E- 9 Matson moved, Johnson seconded, that the Mayor and <br />GENERAL <br />Manager be authorized to sign a General Engineering <br />ENGINEERING <br />Agreement with the consulting firm of Short, <br />AGREEMENT <br />Elliott, Hendrickson and Associates. <br />Roll Call, <br />Ayes:Matson,Cushman, Kehr, Johnson, and Demos. <br />None. <br />Nays: <br />E-10 Cushman moved, Johnson seconded, that Amendment <br />SEH <br />No. <br />4, with the October 13, 1984 Engineering <br />AGREEMENT <br />Agreement with Short, Elliott, and Hendrickson, <br />Inc.,to provide engineering services in the <br />vicinity of I-35W and County Road B-2 be <br />approved. <br />Roll Call, Ayes: <br />Matson, <br />Cushman, <br />Kehr, Johnson, and Demos. <br />Nays:None. <br />E-11 Kehr moved, Johnson seconded, that Resolution <br />RESOLUTION <br />7853, holding the State of Minnesota harmless <br />7853 <br />for future claims resulting from the approval <br />of a variance for width for Cleveland Avenue <br />(MSA 160.241) from County Road B-2 toOakcrest <br />Avenue,be adopted. <br />Roll Call, Ayes: <br />Matson, <br />Cushman, Kehr, Johnson, and Demos. <br />Nays:None. <br /> <br />
