<br />Mastel moved, Maschka seconded, that a grading permit for CSM Investors,
<br />Inc., at 2360 County Road C, be approved as depicted in plans dated September
<br />6, 1996. Roll Call, Ayes: Maschka, Goedeke, Mastel, and Wiski. Nays: None.

<br />Goedeke moved, Mastel seconded, that approval of Agreements 96016 and
<br />96017 for cost participation with Ramsey County for traffic signals on County
<br />Road B at State Farm Road and County Road C at Fairview Avenue and
<br />Cleveland Avenue be approved, and authorizing the Mayor and City Manager to
<br />sign the agreements on behalf of the City. Roll Call, Ayes: Maschka, Goedeke,
<br />Mastel, and Wiski. Nays: None.

<br />Goedeke moved, Maschka seconded, that the public hearing on Arthur Mueller's
<br />request for preliminary and final plat approval at 2224 Acorn Road be continued
<br />to the regular City Council meeting of Monday, October 28, 1996 to allow time
<br />for the applicant to complete a wetland delineation, and to receive preliminary
<br />comments from the Army Corps of Engineers and the Rice Creek Watershed
<br />District, and to allow the Planning Commission to complete their review of this
<br />matter. Roll Call, Ayes: Maschka, Goedeke, Mastel, and Wiski. Nays: None.

<br />Goedeke moved, Mastel seconded, that Resolution 9335, extending the review
<br />period for 60 days, from October 21 to December 21, 1996, for Arthur Mueller's
<br />request for preliminary and final plat approval at 2224 Acorn Road, be adopted.

<br />Truck's request for a vacation of the north half of County Road C-2 right-of-way MACK TRUCK
<br />lying east of Long Lake Road and west ofI-35W be continued to the regular City
<br />Council meeting of Monday, November 25, 1996. Roll Call, Ayes: Maschka,
<br />Goedeke, Mastel, and Wiski. Nays: None.

<br />Maschka moved, Goedeke seconded, that Patrick 1. Daulton's request for a 39
<br />foot setback variance to the 75 foot setback requirement from the ordinary high
<br />water line of a water body in the Shore Land Management Overlay District at
<br />3030 Little Bay Road be denied because the variance cannot meet the statutory
<br />and shoreline definition of hardship, and because an alternative may be available
<br />along the side lot line. Roll Call, Ayes: Maschka, Goedeke, Mastel, and Wiski.
<br />Nays: None.

<br />Mastel moved, Goedeke seconded, that staff be directed to send the staff report
<br />and City Council actions to the Minnesota DNR as required by Minnesota DNR
