RELEASE OF CLAIM - This Release of Claim Agreement is entered into by Vaughn Larson and Bunny Larson, this day of 1991, and shall become effective pursüãñt to its terms. WHEREAS, the City of Roseville and Frank J. Rekuski currently parties to litigation contained in Ramsey County District Court File No. C6-89-5680 (herein the "Ramsey County District Court Caseft); and , are WHEREAS, the Ramsey County District Court Case ~ describes a dispute arising as a result of the construction of various additions and/or improvements to property owned by Frank J. Rekuski and located at 1225 Josephine Avenue, Roseville, MN 55113; and , WHEREAS, a part of the proposed settlement of such dispute would require the payment of $15,000.00 by Frank J. Rekuski to Vaughn Larson and Bunny Larson; and WHEREAS Frank J. Rek~ski, Vaughn Larson and Bunny Larson wish to fully and finally compromise and settle any and all claims which Vaughn Larson and Bunny Larson may have against Frank J. Rekuski as a result of the incidents described in the Ramsey County District Court Case. NOW THEREFORE, in consideration of and upon receipt of the payment of $15,000.00, in the form of a cashier's check which shall be tendered on or before November 20, 1991, Vaughn Larson and Bunny Larson hereby release and forever discharge Frank J. Rekuski, his agents and employees, form any and all claims demands, damages, debts, liabilities, actions, causes of action, and judgments, whether in law or in equity, which Vaughn Larson and Bunny Larson now have, or hereafter may have, based upon, relating to, or arising from the dispute described in the Ramsey County District Court Case.
