Goedeke. <br />J.Ordinances and Resolutions <br />I-1Kysylyczyn moved, Klausing seconded, adoption of a resolution <br />Resolution 9935 <br />supporting restriction on use and sale of lawn fertilizers <br />Restricting Use & Sale <br />containing phosphorus. Roll call, Ayes: Maschka, Mastel, <br />Lawn Fertilizers <br />Klausing, Goedeke and Kysylyczyn. Nays: none. <br />Containing Phosphorus <br />I-2Beets presented this item and summarized the citizen notification <br />Notification Policy <br />process regarding noise variances and construction activity. <br />Kysylyczyn asked that a citizen notification card be distributed to <br />the City Council for their review and comment. Goedeke <br />commented on the scope of notification and costs. Maschka <br />commented on citizen notification and street projects as well as <br />drainage ponds construction. Kysylyczyn commented on the <br />process for obtaining noise variances, or perhaps permits to <br />allow construction activities outside the hours prescribed by the <br />Code. Maschka asked that pond aesthetics be placed on a future <br />work session. Beets reported that in light of the Council?s <br />comments and direction: a) The citizen notification card will be <br />revised and distributed to the City Council; b) pond aesthetics will <br />be on the November Work Session, c) the notification policy will <br />be revised to address drainage pond construction; and d) the <br />revised Notification Policy will be on the November Work <br />Session. <br />(Continued, if necessary) <br />K.Reports and Recommendations <br />L.Items Tabled <br />M.Other Business <br />M-1Kysylyczyn called a recess, he explained that the City Council <br />Recess <br />would convene in an Executive Session and then adjourn for the <br />Convene Executive <br />evening. <br />Session <br />a.Personnel Evaluation of City Manager Neal Beets <br />The entire City Council discussed the job performance of <br />City Manager Neal Beets. [Subsequently, at its September <br />17, 2001 Council Meeting, the City Council summarized <br />their evaluation, as required by Minnesota law. That <br />summary will be part of the September 17, 2001 meeting <br />minutes.] <br />b.Everest Litigation Update: Jeffrey L. Nielsen, The Everest <br />Group, LTD.; Everest Development LTD.; Everest <br />Construction Co.; Everest Property Management Co.; <br />Michael Investments; and Hamline Avenue Properties, <br />L.L.C. v. City of Roseville, Civil No. 98-1625 <br />Kysylyczyn recused himself. The remaining Council <br />Members heard a presentation from Attorney John Baker. <br />c.TIP/Indianhead Litigation Update: Transport International <br />Pool, Inc. v. Regor, Inc. and City of Roseville, Ramsey <br />County District Court No. 62-C8-99-8257 <br />Kysylyczyn recused himself.
