E. The Twin Lakes Business Park is the area generally described on the attached map and by the property identification numbers shown in attachment A. SECTION 2. Development Moratorium. The Roseville City Council hereby adopts a development moratorium pursuant to M.S. 462.355, Sub. 4, on the receipt of and processing of requests for rezoning, building permits (except as described in Section 1.B), conditional use permits, variances and subdivision ofland within the Twin Lakes Master Plan area as identified in the general description below and in the 2002 Comprehensive Guide Plan. SECTION 3. Duration of Moratorium. The development moratorium shall commence on the effective date ofthis ordinance and may continue for up to one year from the date of adoption unless otherwise terminated or extended by action of the City Council. SECTION 4. Exceptions. The development moratorium shall not apply to the Master Developer's requests for applications, permits, and/or approvals consistent with the development agreements(s) in effect at the date of the application. The development moratorium shall not apply to permits for life safety, maintenance and repair (including exterior and on-site modifications and improvements and access doors and docks, which do not extend the existing basic building footprint), interim uses, signage, fencing, public infrastructure, streets, streetscapes, utilities, public facilities, K-12 schools, and parks. The City's Comprehensive Guide Plan, Official Controls, and Building Code Regulations shall continue to apply to these exceptions. SECTION 5. Enforcement. The City ofRoseville may enforce any provision ofthis ordinance by mandamus, injunction, or any other appropriate civil remedy in any court of competent jurisdiction. SECTION 6. Separability. Every section, provision, or part of this ordinance is declared separable from every other section, provision, or part of this ordinance. If any section, provision, or part of this ordinance is adjudged to be invalid by a court of competent jurisdiction, such judgment shall not invalidate any other section, provision, or part ofthis ordinance. SECTION 7. Effective Date. This Ordinance shall be effective upon adoption and publication. SECTION 8. Moratorium AllDlication. The development moratorium shall not apply to the Master Developer requests for applications, permits and/or approvals consistent with the development agreement(s) effective upon the application date. 2
