alarm malfunction, improper installa- tion, or the inadvertence of the user of an alarm system or its employees or agents. False alarms do not include alarms caused by climatic conditions such as tornadoes, thunderstorms, utility line mishaps, or violent conditions of nature, nor do they include alarms caused by third persons over whom the user has no control. 169.030 User Fee. (1) The user of an alarm system which reports more than three (3) false alarms to the City in a single calendar year (and which has received notice of such false alarms), will be charged a fee as follows: For the fourth false alarm, $75.00, and for each subsequent false alarm, an additional, cumulative $25.00 fine (e.g., 4th false alarm = $75.00, 5t~ false alarm = $100.00, 6th false alarm = $125.00, etc.). (2) An alarm user which is required by the City to pay a user fee as a result of a false alarm, may make a written appeal of the false alarm user fee to the Police Chief or Fire Chief, as appropriate, within ten (10) days of notice by the City of the false alarm charge. An adverse decision by the Police Chief or Fire Chief may be appealed to the City Manager, within ten (10) days of receipt of the Policy or Fire Chief's decision. The City Manager will have authority to make a final de~ermination as to whether or not the user is to be charged a user fee for the fa::'se alarms. 169.040. Payment of Fees. (1) Payment of user fees provided for herein must be paid to the City Treasurer wi~hin thirty (30) days from the date of notice by the City to the alarm user.
