<br />alarm malfunction, improper installa- <br />tion, or the inadvertence of the user of <br />an alarm system or its employees or <br />agents. False alarms do not include <br />alarms caused by climatic conditions <br />such as tornadoes, thunderstorms, <br />utility line mishaps, or violent <br />conditions of nature, nor do they <br />include alarms caused by third persons <br />over whom the user has no control. <br /> <br />169.030 User Fee. <br /> <br />(1) The user of an alarm system which <br />reports more than three (3) false alarms <br />to the City in a single calendar year <br />(and which has received notice of such <br />false alarms), will be charged a fee as <br />follows: For the fourth false alarm, <br />$75.00, and for each subsequent false <br />alarm, an additional, cumulative $25.00 <br />fine (e.g., 4th false alarm = $75.00, <br />5t~ false alarm = $100.00, 6th false <br />alarm = $125.00, etc.). <br /> <br />(2) An alarm user which is required by the <br />City to pay a user fee as a result of a <br />false alarm, may make a written appeal <br />of the false alarm user fee to the <br />Police Chief or Fire Chief, as <br />appropriate, within ten (10) days of <br />notice by the City of the false alarm <br />charge. An adverse decision by the <br />Police Chief or Fire Chief may be <br />appealed to the City Manager, within ten <br />(10) days of receipt of the Policy or <br />Fire Chief's decision. The City Manager <br />will have authority to make a final <br />de~ermination as to whether or not the <br />user is to be charged a user fee for the <br />fa::'se alarms. <br /> <br />169.040. Payment of Fees. <br /> <br />(1) Payment of user fees provided for herein <br />must be paid to the City Treasurer <br />wi~hin thirty (30) days from the date of <br />notice by the City to the alarm user. <br />Failure to pay the fee within thirty <br />(30) days will result in the imposition <br />of a penalty of ten percent (10%) of the <br />user fee. <br /> <br />(2) All unpaid user fees and penalties shall <br />
