<br />SECTION 10 <br /> <br />.'; .., <br />'016 <br /> <br />It shall be unlawful for any person duly licensed to sell non- <br />intoxicating malt liquor but not duly licensed to sell intoxicating <br />liquor, or for any of his agents, servants or employees to have in <br />their possession on said licensed premises intoxicating liquor for the <br />purpose of consumption by anyone. <br /> <br />SECTION II <br /> <br />It shall be unlawful for such licensee, his agents, servants or <br />employees to permit the consumption of intoxicating liquor upon said <br />premises. <br /> <br />SECTION 12 <br /> <br />For the purpose of this ordinance, intoxicating liquor is hereby <br />defined to mean and include ethyl alcohol and any distilled, fermented, <br />spiritous, vinous or malt liquid of any kind potable as a beverage <br />~ which liquid contains any alcoholic content in excess of 3.2% thereof <br />by weight. <br /> <br />SECTION 13 <br /> <br />The conviction of the licensee or of any clerk, barkeeper, agent, <br />servant or employee of said licensee on the violation of this ordinance <br />shall be deemed sufficient cause by the Vill8~e Council to revoke any <br />license issued to such licensee. <br /> <br />SECTION 14 <br /> <br />Licenses herein provided for shall run until the following July I, <br />and if for a shorter period than one year, the license fee shall be <br />prorated on a monthly basis. <br /> <br />SECTION 15 <br /> <br />Any person now licensed to sell non-intoxicating malt liquor by <br />the Town of Rose may continue to sell such non-intoxicating malt liquors <br />until the expiration of said license without obtaining a license from <br />the Village of Roseville. <br /> <br />SECTION 16 <br /> <br />Nothing herein contained shall be construed to prohibit the sale <br />and delivery in original packages direct to the consumer by the manu- <br />facturer or distributor of non-intoxicating malt liQuors. <br /> <br />SECTION 17 <br /> <br />Any person violating any of the provisions of this ordinance shall <br />be guilty of a misdemeanor punishable by a fine not to exceed $IOO.OO <br />or by imprisonment for a period not exceeding 90 days. <br /> <br />~ <br />
