<br />ORDINANCE NO. 122 <br /> <br />,57 <br /> <br />AN ORDINANCE AMENDING ORDINANCE NO. 102 ENTITLED, "AN ORDINANCE REGULATING THE SALE <br />OF NON-INTOXICATING MALT LIQUOR WITHIN THE VILLAGE OF ROSEVILLE; PROVIDING FOR SUCH <br />SALES BY DULY LICENSED PERSONS; ESTABLJm:ml} REGULA TIONS FOR THE OPERAT ION OF PRICES <br />FOR SUCH NOlT-UITOXICATING MALT LIQUORS SOLD; PROVIDING REGULATIONS FOR THE GRANT- <br />ING OF SUCH LICENSES; FIXING LICENSE FEE; PROVIDING PENALTIES FOR THE VIOIATIOU <br />THEREOF" APPROVED MAY 27, 1948. <br /> <br />The Village Council of Roseville do ordain as follows: <br /> <br />SECTION 1 <br /> <br />That Ordinance No. 102 entitled "An Ordinance Regulating the Sale of Non-Intoxi- <br />cating Malt Liquor Within the Village of Rosevi1le; Providing for such Sales by Duly <br />Licensed Persons; Establishing Regulations for the Operation of Prices for such Non- <br />Intoxicating Malt Liquors Sold; Providing Regulations for the Granting of such Lioenses; <br />Fixing Lioense Fee; Providing Penalties for the Violation Thereof" be amended by strik- <br />ing there fram Seotion 6 and inserting in lieu thereof the following: <br /> <br />SECTION 6 <br /> <br />lie) suoh non-intoxicating malt liquor in excess of one-half of one per cent of <br />alcohol by volume shall be sold on any Sunday between the hours of 1:00 o'clock A.M. <br />and 12:00 o'olock noon nor between the hours of 1:00 o'clock A.M. and 8:00 o'clock <br />P.M. on any election day in the district in which the eleotion shall be held, and no <br />sale shall be made between the hours of 1:00 o'olook A.M. and 8:00 o'clock A.M. on <br />any week day, Monday through Saturday inclusive. No on sale lioensee shall permit <br />811Y suoh non-intoxioating malt liquor in exoess of one-half of one peroent of a1oohol <br />by volume to be oonsumed on his premises during the hours when the sale thereof is <br />by this ordinance prohibited." <br /> <br />SECTION 2 <br /> <br />That said Ordinance be further amended by striking therefrom Seotion 11 and in- <br />serting in lieu thereof the following: <br /> <br />"SECTION 11 <br /> <br />It shall be unlawful for any person to oonsume or display intoxicating liquor <br />between the hours of 12:00 o'olook midnight and 8:00 o'c1ook A.M. and it is unlawful <br />for such licensee, his agents, servants or employees to permit the oonsumption or <br />display of intoxioating liquor upon said premises between the hours of 12:00 o'clock <br />midnight and 8:00 o'olook A.M. or in any manner to serve or permit the serving of <br />liquor for the purpose of mixing with intoxioating liquor between suoh hours and the <br />!8rving of nny suoh liquor for the purpose of mixing with intoxicating liquor is <br />prima facie evidence that liquor is being permitted to be oonsumed or displayed <br />oontrary to the provisions of this Ordinance." <br /> <br />SECTION :; <br /> <br />This Ordinance shall take effect and be in force from. and after its passage. <br /> <br />Passed by the Council this 5th day of July, 1949. <br />Approved: ' <br /> <br />President <br /> <br />Attest: <br /> <br />
